Sec. 20.231. - DEFINITIONS:

For the purpose of this Division the following words and phrases shall have the meanings respectively ascribed to them:

COMMERCIAL PARKING PERMIT: A permit issued pursuant to Section 20.232 of this Division.

COMMERCIAL PERMIT PARKING AREA: A commercial or mixed use area designated as provided in this Division wherein vehicles displaying a valid permit issued pursuant to this Division shall be exempt from the parking time restrictions established in Section 20.238 of this Division.

COMMERCIAL VEHICLE: For purposes of this Section, the term "commercial vehicle" shall have the meaning ascribed to it by Vehicle Code Section 260.

DIRECTOR: The Community Development and Transportation Director.

EMPLOYEE: A person who is employed by an employer as defined by this Section.

EMPLOYER: A person who operates a business with a valid business license issued by Redwood City within a commercial permit parking area designated pursuant to this Division.

MOTOR VEHICLE: An automobile, truck, trailer, house car, motorcycle, or other motor-driven device for transportation, not in excess of six thousand (6,000) pounds gross weight.

Sec. 20.232. - ISSUANCE OF PERMITS:

Commercial parking permits shall be issued by the Director. Parking permits may be issued to employers or employees pursuant to the terms of a resolution pursuant to Section 20.238 of this division.

Sec. 20.233. - DURATION OF PERMITS TO BE ISSUED:

Each commercial parking permit issued by the Director shall be valid for a maximum of one (1) year unless otherwise stated on the permit. Permits can be obtained at any point in the year, but will only be valid for the current calendar year, unless otherwise noted on the permit. At the start of each new calendar year, a grace period until January 15 will be provided for permit holders to renew and obtain permits for the new calendar year. The Director shall cause to be prepared and issue effective on or about January 1 of each year, a distinctively colored sticker for issuance to permittees of commercial parking permits, which sticker shall be displayed within the motor vehicle or commercial vehicle for which a permit is issued at the location specified in Section 20.235 of this Division.

Sec. 20.235. - DISPLAY OF PERMITS:

Commercial parking permits shall be affixed to the rear window on the driver's side and be visible.

Sec. 20.236. - FEES FOR ISSUANCE:

The Council may establish by resolution fees for the administration of commercial parking permits and for the replacement of lost, damaged or destroyed permits or stickers.

Sec. 20.237. - TERMINATION OF PERMITS:

Commercial parking permits shall terminate upon any of the following events:

A. Upon the termination of employment of the permittee from his or her employer within a commercial parking area.

B. Upon the closure of the employer's business or relocation outside of the commercial parking area.

C. Upon expiration of the calendar year for which a permit has been issued or the date identified on the permit, whichever is later.

Sec. 20.238. - POSTING OF COMMERCIAL PERMIT PARKING AREA; REQUIREMENTS FOR OBTAINING…

Upon the adoption of a resolution by the Council designating a commercial permit parking area, the City Manager shall order appropriate signs to be erected in such area, indicating prominently thereon the time limitation, day or days and hours during which parking shall be restricted. Parking restrictions established pursuant to this Division shall be in effect between the hours of seven o'clock (7:00) A.M. and six o'clock (6:00) P.M. from Monday through Friday with holidays specified in Section 20.1 of this Chapter excluded, unless otherwise established by resolution setting different parking restrictions for a particular commercial permit parking area. Such resolution shall also state the requirements for obtaining a commercial parking permit.

Sec. 20.239. - VIOLATIONS:

A. It is unlawful and a violation of this Division, unless expressly provided to the contrary herein, for any person to park a motor vehicle or commercial vehicle on a street in a commercial permit parking area beyond the parking time limit, posted by signs giving notice thereof and erected pursuant to this Division, without a valid commercial parking permit sticker properly affixed to such vehicle.

B. No person shall park a motor vehicle or commercial vehicle within a commercial permit parking area with a commercial parking permit sticker affixed to such vehicle evidencing that such permit has expired or which has been terminated or is not valid for the area in which such vehicle has been parked beyond the parking time limit posted by signs giving notice thereof and erected pursuant to this Division.

C. It is unlawful and a violation of this Division for a person falsely to represent himself or herself as eligible for a commercial parking permit or to furnish false information in an application for any such permits.

D. It is unlawful and a violation of this Division for any person to use or display, or permit the use or display of, a commercial parking permit sticker pertaining thereto on a motor vehicle or commercial vehicle other than that vehicle for which such permit sticker was issued.

Sec. 20.240. - EXEMPTIONS:

A. Any motor vehicle or commercial vehicle on which is displayed a valid commercial parking permit sticker pertaining thereto as provided for herein may be parked on a street in the commercial permit parking area pertaining thereto without limitation of the time restrictions established by the Council under Section 20.238. Such parking permit shall not guarantee or reserve the holder thereof an on-street parking space on a street in such commercial permit parking area. All vehicles issued a commercial parking permit are subject to all other parking restrictions and regulations of the California Vehicle Code and this Code.

B. This Division does not apply to ambulances, fire department vehicles, police vehicles, public utility vehicles or other official or emergency vehicles which have an official seal or logo identifying them as such.

C. Commercial vehicles parked for the purpose of loading or delivery of goods, wares or merchandise from or to any building or structure in a commercial permit parking area or delivering materials to be used for construction purposes, including but not limited to repair, alteration, remodeling, construction or reconstruction of any such building or structure for which a building permit has previously been obtained shall be exempt from the time restrictions established by the Council under Section 20.238. Loading for the employer's standard business operations are not exempt.

Sec. 20.241. - PENALTY:

The violation of any of the provisions of this Division shall be deemed an infraction which, upon conviction thereof, shall be punishable as specified in subdivision B of Section 1.7 of this Code.

Vehicles parked in violation of this Division shall be deemed overtime parking and shall be punishable as specified in Section 20.95.1 of this Code.
