Redwood City Municipal Code Ch. 18C Regulation of Display of Adult Materials

Sec. 18C.1. - DEFINITIONS:

As used in this Chapter, the following words and phrases shall have the following meanings: ;b0;ADULT MATERIAL: All material that is defined as "harmful matter", in section 313(a) of the California Penal Code.

COMMERCIAL ESTABLISHMENT: Any place of business in which minors are permitted.

DISPLAY: Exhibiting or exposing adult material knowingly so that it is within open view of patrons, invitees, and visitors to the premises where such material is located, except in a public place where minors are excluded, and except where devices commonly known as blinder racks, or blinders, are placed in front of such material so that the lower two-thirds (⅔) of the material is not exposed to view.

KNOWINGLY: Being aware of the character of the matter.

MATERIAL OR MATTER: Any book, magazine, newspaper, video recording, or other printed or written material, or any picture, drawing, photograph, motion picture, or other pictorial representation.

MINOR: Any natural person under eighteen (18) years of age.

PERSON: Any individual, partnership, firm, association, corporation, limited liability company, or other legal entity.

Sec. 18C.2. - DISPLAY OF ADULT MATERIAL PROHIBITED:

No person shall display adult material, or permit, or allow the display of adult material in any commercial establishment.

Sec. 18C.3. - VIOLATION—PENALTY:

Any person, whether as principal, agent, employee, or otherwise, violating or causing the violation of any of the provisions of this Chapter shall be guilty of an infraction, and/or subject to an administrative citation.

Sec. 18C.4. - PUBLIC NUISANCE:

In addition to the penalty provided in this Chapter, violation of any section or sections of this Chapter is declared to be a public nuisance, and may be abated by the City.
