Sec. 20.160. - ISSUANCE—AUTHORITY OF CITY ENGINEER; LIMITATION ON NUMBER:

The City Engineer is hereby authorized to issue temporary parking meter permits for temporary loading and unloading zones, courtesy pre-paid parking spaces, and/or temporary construction zones to persons owning or occupying property, or licensed contractors performing work on property, adjacent to parking spaces located within a parking meter zone. Not more than one (1) such permit shall be issued in connection with any one (1) business enterprise at any given time; however, the permit may designate as many parking spaces as deemed necessary by the City Engineer.

Sec. 20.161. - ISSUANCE—CONDITIONS PREREQUISITE:

Temporary parking meter permits shall only be issued by the City Engineer after due application as provided in this Division when traffic and parking conditions indicate that there is a need to limit the parking by the general public during certain specified dates and times in certain parking areas within a parking meter zone for the purpose of allowing construction activity, merchandise or materials to be loaded and unloaded, or temporary parking to accommodate the adjacent property.

Sec. 20.162. - APPLICATION—FORM; INFORMATION REQUIRED:

Application for the issuance of a temporary parking meter permit shall be made on a form approved by the City Engineer, and shall require the following information:

A. Name and address of applicant and the place of business for which the application is being submitted.

B. A statement of the reasons for the need for a temporary parking meter permit.

C. The dates, times and parking space meter number(s) for which the temporary parking meter permit is being requested.

D. Such other relevant information as the City Engineer may require.

Sec. 20.163. - APPLICATION—REFERRAL TO POLICE DEPARTMENT; APPEAL FROM DENIAL OR…

The City Engineer may refer an application for a temporary parking meter permit to the Police Department for a determination as to whether traffic and parking conditions indicate a need to limit parking as described in Section 20.161.

The City Engineer may refer an application for a temporary parking meter permit to the City Building Division for a report on permitted construction on the subject property.

If an application has been denied or revoked under Section 20.167, the applicant may appeal the denial or revocation to the Community Development Director, whose decision will be the final determination of the City.

Sec. 20.164. - TEMPORARY PARKING METER PERMIT:

If a temporary parking meter permit is issued, the City Engineer shall issue the permit together with a "No Parking" placard for each parking space being reserved, which placard shall be an official City sign informing the public that parking is prohibited in that space except as permitted by the temporary parking meter permit. The applicant may attach the placard to an applicant-provided parking space barrier. All placards remain the property of the City and must be returned by the applicant to the City within two (2) business days of the expiration or revocation of the Temporary Parking Meter Permit.

The City Engineer may require each placard to be numbered or otherwise identified and may print thereon the parking space number, dates and hours during which it may be utilized.

Sec. 20.165. - FEE; PAYMENT IN ADVANCE:

Temporary parking meter permits shall be issued upon payment of an application fee in an amount set by resolution of the City Council, together with the parking meter fees for each meter multiplied by the total number of hours for which parking fees are charged, per each day for which the temporary parking meter permit is issued. All fees shall be paid in advance prior to issuance of the permit.

Sec. 20.166. - REVOCATION; USER TO COMPLY WITH REGULATIONS; RETURN UPON DEMAND:

The City Engineer may revoke any temporary parking meter permit for any of the following reasons:

A. Automatically at the time the temporary parking meter permit expires.

B. When a person has failed to pay the fee as provided in this Division.

C. When the City Engineer is satisfied that the circumstances no longer require the limited use of such parking.

D. When the person is found to be using the temporary parking meter permit placard for other purposes than those specified in the issued permit.

E. For violation of any of the provisions of this Division.

Sec. 20.167. - VIOLATION:

It shall be unlawful for any person to use a temporary parking meter permit placard on any parking space after revocation or in any manner except in strict compliance with the provisions of the issued Permit and of this Article. It shall be unlawful for any person to fail to return a temporary parking meter permit placard after demand therefor by the City Engineer.

Sec. 20.168. - RESTRICTIONS ON PARKING IN SPACE DESIGNATED "NO PARKING" BY TEMPORARY…

It shall be unlawful for any person to park, or cause to be parked, any vehicle operated or controlled by such person in any parking space designated as no parking by a Temporary Parking Meter Permit placard unless such parking is in compliance with the conditions of the placard.

Sec. 20.169. - PARKING FEES TO ACCRUE TO CITY:

After the issuance of a temporary parking meter permit, if any parking fees are paid for parking spaces subject to such permit, such funds shall accrue to the City.
