Sec. 18.60. - ADOPTION AS PROVIDED IN ARTICLE:

The general plan or any part or element thereof, and any amendment to such plan or any part or element thereof, shall be adopted in the manner provided in this Article.

Sec. 18.61. - PROCEEDINGS INITIATED BY RESOLUTION OF INTENTION OF COUNCIL OR PLANNING…

Proceedings may be initiated by either resolution of intention of the Planning Commission or the City Council.

A resolution of intention of the Council may either direct the Commission to prepare a plan, or part or element thereof, or may refer a proposal to the Commission for review. The resolution may establish a time within which the Commission shall return its report, recommendations and any revised alternative plan.

Sec. 18.62. - HEARING BY PLANNING COMMISSION; NOTICE OF HEARING:

The Planning Commission shall hold a public hearing before approving a general plan or any part or element thereof, or any amendment to such plan or any part or element thereof. The time and place of the hearing shall be set by, and notice thereof given by, the Planning Director at least ten (10) calendar days before the hearing by publication at least once in a newspaper of general circulation published and circulated in the City.

In addition to notice by publication, the Planning Commission may direct the Planning Director to give notice of the hearing in such other manner as it may deem necessary or desirable.

Any hearing may be continued from time to time.

Sec. 18.63. - APPROVAL TO BE BY FOUR MEMBERS OF PLANNING COMMISSION:

The approval by the Planning Commission of the general plan or any part or element thereof, or any amendment to such plan or any part or element thereof, shall be by the affirmative vote of at least four (4) members.

Sec. 18.64. - TRANSMITTAL TO COUNCIL AFTER APPROVAL BY PLANNING COMMISSION:

Upon approval by the Planning Commission of the general plan or any part or element thereof, or any amendment to such plan or any part or element thereof, it shall be transmitted to the City Council by the Planning Director.

Sec. 18.65. - HEARING BY COUNCIL; NOTICE OF HEARING:

Before adopting the general plan or any part or element thereof, or any amendment to such plan or any part or element thereof, the City Council shall hold a public hearing. The time and place of the hearing shall be set by, and notice thereof given by, the City Clerk in the time and manner provided above for the giving of notice of the hearing by the Planning Commission.

In addition to notice by publication, further notice may be given of the hearing in such other manner as deemed necessary or desirable.

Any hearing may be continued from time to time.

Sec. 18.66. - CHANGES, ETC., BY COUNCIL; REFERRAL TO PLANNING COMMISSION:

In adopting a general plan or any part or element thereof, or any amendment to such plan or any part or element thereof, the City Council may make changes, additions or revisions thereto. If deemed necessary, the City Council may refer any proposed change, addition or revision to the Planning Commission for a report. Failure of the Planning Commission to report within forty (40) days after the referral, or such other period as may be designated by the City Council, shall be deemed to be approval of the proposed change or addition. It shall not be necessary for the Planning Commission to hold a public hearing on the change, addition or revision.

Sec. 18.67. - ADOPTION BY COUNCIL BY RESOLUTION; SUPPLEMENTING:

The adoption of the general plan or any part or element thereof, or any amendment to such plan or any part or element thereof, shall be by resolution of the City Council.

Any general plan, or part or element thereof, may be supplemented by more specific development plans which may be adopted either as amendments to the general plan or as interim plans that do not affect the general plan.

Sec. 18.68. - PLANNING COMMISSION MAKE RECOMMENDATIONS, ETC., AFTER ADOPTION BY COUNCIL:

After the City Council has adopted all or part of a general plan, the Planning Commission may:

A. Investigate and make recommendations to the City Council upon reasonable and practical means for putting into effect the general plan or part thereof, in order that it will serve as a pattern and guide for the orderly physical growth and development of the City. The measures recommended may include plans, regulations and financial reports.

B. Endeavor to promote public interest in and understanding of the general plan, and regulations relating to it.

C. Consult and advise with public officials and agencies, public utility companies, civic, educational, professional organizations and citizens generally in regard to carrying out the general plan.
