Sec. 11.60. - PROVISIONS OF DIVISION APPLICABLE TO CERTAIN SUBDIVISIONS:¶
The provisions of this Division shall be applicable to the following subdivisions of real property approved by the City after the effective date [2] of this Division:
A. Every subdivision containing five (5) or more lots.
B. Every subdivision establishing a new street right-of-way or an extension of an existing right-of-way.
C. Every subdivision, regardless of the number of lots, which lies contiguous to an existing subdivision in which electric, communication and other service and utility facilities were installed under ground pursuant to this Article or which lies contiguous to an underground utility district. This Division shall not apply to any lots in a subdivision that are immediately adjacent to existing overhead facilities and can be served from such facilities without the installation of any new pole.

Sec. 11.61. - UNLAWFUL TO INSTALL OVERHEAD UTILITIES IN SPECIFIED SUBDIVISIONS:¶
It shall be unlawful for any person, including subdividers and utility companies, to install or cause the installation of any pole, overhead wire or associated overhead structures in any subdivision described in Section 11.60, except as permitted by Sections 11.60 and 11.62.

Sec. 11.62. - EXCEPTIONS TO REQUIREMENT OF UNDERGROUND FACILITIES:¶
All service and utility distribution facilities (including but not limited to electric, communication and cable television lines) to be installed in and for the purpose of supplying service to any new subdivision as defined in Section 11.60, shall be placed underground with the following exceptions:
A. The following equipment appurtenant to underground facilities: Surface mounted transformers, pedestal mounted terminal boxes and meter cabinets, and concealed ducts;
B. Poles used exclusively for police and fire alarm boxes or any similar municipal equipment installed under the supervision and to the satisfaction of the City Engineer; and
C. Poles and associated structures used exclusively for street lighting or traffic-control.

Sec. 11.63. - SUBDIVIDER TO COMPLY WITH PROVISIONS OF DIVISION; APPROVAL OF FINAL…¶
It shall be the responsibility of the subdivider to comply with the requirements of this Division and the subdivider shall make all necessary arrangements with the utility companies, communications companies or other individuals or organizations involved in the installation of said facilities.
The utility companies, communications companies or other individuals or organizations involved in the installation of said facilities shall cooperate fully with the subdivider in the planning and installation of the underground facilities in accordance with their rules, regulations and tariffs on file with the Commission and/or their franchise on file with the City Clerk.
No subdivision final map shall be approved by the City Council unless provision for the installation of underground utilities facilities to each lot is included in the subdivision improvement agreement or is otherwise provided for.

Sec. 11.64. - GRANTING OF EXCEPTIONS TO DIVISION:¶
In connection with the processing of any subdivision application, exceptions or conditional exceptions may be granted to the provisions of this Division 4 under the same procedures established for the granting of exceptions to the provisions of Chapter 30 of this Code.

Sec. 11.65. - COMPLETE UNDERGROUND SERVICE MAY BE REQUIRED FOR APPROVAL OF SUBDIVISION…¶
Notwithstanding the exceptions specified in Section 11.60 complete underground service for any subdivision may be required in connection with the approval of any subdivision map by the City.
