Sec. 20.200. - DEFINITIONS:¶
For the purpose of this Division the following words and phrases shall have the meanings respectively ascribed to them:
DIRECTOR: The Community Development and Transportation Director.
MOTOR VEHICLE: An automobile, truck, trailer, house car, motorcycle, or other motor-driven device for transportation, not in excess of six thousand (6,000) pounds gross weight.
OWNER: A person who has an ownership interest in a parcel of real property within a residential permit parking area designated pursuant to this Division.
RESIDENT: A person who lives in a residential permit parking area as his/her permanent place of residence, either as a tenant or owner.
RESIDENTIAL PARKING PERMIT: A permit issued pursuant to Section 20.201 of this Division.
RESIDENTIAL PERMIT PARKING AREA: A residential area designated as provided in this Division wherein vehicles displaying a valid permit issued pursuant to this Division shall be exempt from the parking time restrictions established in Section 20.207 of this Division.
VISITOR PARKING PERMIT: A permit issued pursuant to Section 20.203 which is valid for a period of either one (1) day or fourteen (14) days.

Sec. 20.201. - ISSUANCE OF PERMITS:¶
Residential parking permits shall be issued by the Director. Parking permits may be issued to an owner or resident of property within a residential parking permit area or to a guest of such an owner or resident duly authorized by the owner or resident to apply for a residential parking permit, provided, that a residential parking permit shall only be issued to an owner, resident, or guest who has a motor vehicle currently registered in his or her name, or who has lawful possession of a motor vehicle for his or her exclusive use and/or which is under his or her control. Not more than one (1) residential parking permit shall be issued for any motor vehicle. The Director may establish rules and regulations necessary or appropriate to carry out the purpose of this Division. The Director shall require each applicant for a residential parking permit to establish proof of residency and vehicle ownership, possession or control in compliance with this Division.

Sec. 20.202. - DURATION AND LIMIT ON NUMBER OF PERMITS TO BE ISSUED:¶
There shall be no more than three (3) permits that may be issued to any single residential address within a residential permit parking area, unless otherwise established by resolution for a particular residential permit parking area. A separate application shall be filed for each motor vehicle. Each residential parking permit issued by the Director shall be valid for a maximum of one (1) year unless otherwise stated on the permit. The Director shall cause to be prepared and issue effective on or about January 1 of each year, a distinctively colored sticker for issuance to permittees of residential parking permits, which sticker shall be affixed to the motor vehicle for which a permit is issued at the location specified in Section 20.204 of this Division.

Sec. 20.203. - VISITOR PARKING PERMITS:¶
A. Visitor parking permits may be issued to residents in a residential parking permit area. The Director shall issue visitor parking permits in accordance with this Section. A visitor parking permit shall be of limited duration, but shall otherwise grant to the holder thereof all the rights and privileges of a regular residential parking permit.
B. A visitor parking permit shall include: The term for which it is valid, the license plate number of the motor vehicle to which it applies, an identification number to associate with an address in the permit area, and shall designate the applicable residential permit parking area.
C. Visitor parking permits shall be of two (2) types:
One-day visitor parking permit - A one-day visitor parking permit shall, during the date indicated upon the face of said permit, exempt the applicable vehicle from the posted parking time restrictions of the applicable residential permit parking area; and
Fourteen-day visitor parking permit - A fourteen-day visitor parking permit shall, for the period of fourteen (14) days commencing upon the date indicated upon the face of said permit, exempt the applicable vehicle from the posted parking time restrictions of the applicable residential permit parking area.
D. No more than ten (10) total visitor parking permits shall be issued annually to visitors at any one (1) dwelling unit, unless otherwise established by resolution for a particular residential permit parking area. No more than five (5) one-day visitor parking permits per dwelling unit, and no more than two (2) fourteen-day visitor parking permits per dwelling unit shall be issued at any one (1) time.

Sec. 20.204. - DISPLAY OF PERMITS:¶
Residential parking permits shall be affixed to a motor vehicle at the lower corner of the rear window on the driver's side and visible.
Visitor parking permits shall be placed inside the vehicle, and visible in their entirety through the rear window on the driver's side.

Sec. 20.205. - FEES FOR ISSUANCE; DURATION OF PERMITS:¶
The Council may establish by resolution fees for the administration of residential parking permits, visitor parking permits, and for the replacement of lost, damaged or destroyed permits or stickers. Residential parking permits shall be valid for not more than one (1) year, unless otherwise stated on the permit. Every permit shall be renewable prior to January 15 of each year.

Sec. 20.206. - TERMINATION OF PERMITS:¶
Residential and visitor parking permits shall terminate upon any of the following events:
A. Upon the transfer or sale of the vehicle for which a permit has been issued.
B. Upon the relocation of the permittee from his or her residence within a residential parking area to another residence, whether within or outside said area.
C. Upon expiration of the calendar year for which a permit has been issued or the date identified on the visitor permit, whichever is later.

Sec. 20.207. - POSTING OF RESIDENTIAL PERMIT PARKING AREA:¶
Upon the adoption of a resolution by the Council designating a residential permit parking area, the City Manager shall order appropriate signs to be erected in such area, indicating prominently thereon the time limitation, day or days and hours during which parking shall be restricted. Parking restrictions established pursuant to this Division shall be in effect between the hours of seven o'clock (7:00) A.M. and six o'clock (6:00) P.M. from Monday through Friday with holidays specified in Section 20.1 of this Chapter excluded, unless otherwise established by resolution setting different parking restrictions for a particular residential permit parking area.

Sec. 20.208. - VIOLATIONS:¶
A. It is unlawful and a violation of this Division, unless expressly provided to the contrary herein, for any person to park a motor vehicle on a street in a residential permit parking area beyond the parking time limit, posted by signs giving notice thereof and erected pursuant to this Division, without a valid residential parking permit and sticker properly affixed to such vehicle.
B. No person shall park a motor vehicle within a residential permit parking area with a residential parking permit or sticker affixed to such vehicle evidencing that such permit has expired or which has been terminated or is not valid for the area in which such vehicle has been parked beyond the parking time limit posted by signs giving notice thereof and erected pursuant to this Division.
C. It is unlawful and a violation of this Division for a person falsely to represent himself or herself as eligible for a residential parking permit, a visitor parking permit, or to furnish false information in an application for any such permits.
D. It is unlawful and a violation of this Division for any person to use or display, or permit the use or display of, a residential parking permit, a visitor parking permit, or a sticker pertaining thereto on a motor vehicle other than that vehicle for which such permit or sticker was issued.

Sec. 20.209. - EXEMPTIONS:¶
A. Any motor vehicle on which is displayed a valid residential parking permit, visitor parking permit, or sticker pertaining thereto as provided for herein may be parked on a street in the residential permit parking area pertaining thereto without limitation of the time restrictions established by the Council under Section 20.207. Such parking permit shall not guarantee or reserve the holder thereof an on-street parking space on a street in such residential permit parking area.
B. This Division does not apply to ambulances, fire department vehicles, police vehicles, public utility vehicles or other official or emergency vehicles which have an official seal or logo identifying them as such.
C. Commercial vehicles parked for the purpose of loading or delivery of goods, wares or merchandise from or to any building or structure in a residential permit parking area or delivering materials to be used in the repair, alteration, remodeling, construction or reconstruction of any such building or structure for which a building permit has previously been obtained shall be exempt from the time restrictions established by the Council under Section 20.207.

Sec. 20.210. - PENALTY:¶
The violation of any of the provisions of this Division shall be deemed an infraction which, upon conviction thereof, shall be punishable as specified in subdivision B of Section 1.7 of this Code.
