§ 3-7.201. Purpose and intent of chapter.

This chapter is adopted with the purpose and intent of the orderly delegation of authority in conformity with the Charter of the City through the City Manager to the appropriate operating department to provide an orderly and uniform traffic control and enforcement program. The Council may, on its own motion, after due consideration of all the evidence, and in consideration of the public welfare and convenience, rescind, modify or change any finding, act or determination of the City Manager, Chief of Police or the Director of Street Lighting and Traffic Control, and may act as a Board of Appeals and set such public hearings as it deems necessary. After due consideration of the evidence presented at such hearings, the Council may make a finding, and its action shall be conclusive and shall rescind any act or determination or order of the City Manager, the Chief of Police or the Director of Street Lighting and Traffic Control to the end that the public welfare is protected and substantial justice done.

§ 3-7.202. Annual traffic safety report.

The Traffic Safety Officer and the Director of Street Lighting and Traffic Control shall annually prepare a joint traffic report which shall be filed with the City Manager. Such report shall contain information on traffic matters in the City as follows:

(a) The number of traffic accidents, the number of persons killed and injured, and other pertinent traffic accident data;

(b) The number of traffic accidents investigated and other pertinent data on the safety activities of the police; and

(c) The plans and recommendations of the department for future safety traffic activities.

§ 3-7.203. Emergency and experimental regulations.

The City Manager is hereby empowered to make regulations necessary to make effective the provisions of this chapter and other traffic laws of the City, and the Chief of Police shall enforce temporary or experimental regulations to cover emergencies or special conditions. Such temporary or experimental regulations shall not remain in effect for more than 90 days.

Whenever, pursuant to the provisions of this chapter, the approval of the Council is required as to any action taken by the City Manager, such approval may be granted by resolution or motion duly adopted unless it is expressly provided by the provisions of this chapter that approval be given by ordinance.
