§ 3-7.401. Director of Street Lighting and Traffic Control: Traffic Safety Officer:…

(a) Consultation with City Manager. The Director of Street Lighting and Traffic Control and the Traffic Safety Officer shall consult with the City Manager in matters involving the regulation and control of vehicle traffic on public streets and highways.

(b) Authorized Installations. Whenever, by the provisions of this chapter, the City Manager is authorized to install any traffic control devices, such authority is made dependent upon his determination only upon the basis of traffic engineering principles and traffic investigations and in accordance with such standards, limitations and rules as are laid down in this chapter with reference to the particular kind of installation under consideration.

(c) Directed Installations. It shall be the duty of the Director of Street Lighting and Traffic Control to install traffic control devices whenever directed by any provision of this chapter at any particular location specified in this chapter and at any other particular location where he may be so directed by any other order of the City.

(d) Installations Essential to Effectiveness of Traffic Laws. Whenever any traffic law of the State or any traffic regulation set forth in this chapter requires for its effectiveness that traffic control devices be installed to give notice to the public of the operation or application of such law or regulation, the City Manager is hereby authorized to install the necessary devices, subject to any limitations or restrictions set forth in the law or regulation involved.

(e) Additional Installations. Subject to the requirements of subsection (a) of this section, the City Manager is hereby authorized to install such additional traffic control devices, including directional signs, not expressly provided for in this chapter, as he may deem necessary to guide or warn traffic, subject to sound traffic engineering principles.

(f) Authority of the Council. No officer, board or department of the City, and no private agency or person, shall install, place or maintain any traffic control device within the purview of this chapter except upon the order of the City Manager as directed by motion of the Council duly passed and approved at a regular or special meeting of the Council.

§ 3-7.402. Removal, relocation and discontinuance.

The City Manager, under the direction of the Council, shall remove, relocate or discontinue the operation of any traffic control devices enumerated in this section whenever the Council shall determine in any particular case that the factors or conditions which warranted or required the installation no longer exist or obtain:

(a) Official traffic signals;

(b) Stop signs;

(c) Signs or marks limiting or prohibiting stopping, standing or parking except from locations where the maintenance of such signs or marks are specifically required by law;

(d) Crosswalks and safety zones; and

(e) Directional signs, lane lines, turning buttons, left turn signs and other traffic control devices to guide or warn traffic, the installation of which is, by law, left to the reasonable determination of the Chief of Police.

§ 3-7.403. Hours of operation.

The hours and days during which any traffic control device is to be in operation, or to be in effect, except in those cases where such hours or days are specified in this article, shall be determined according to the traffic conditions prevailing at any particular location, and may be altered from time to time as such traffic conditions may justify or require.

§ 3-7.404. Installation of traffic signals.

(a) The City Manager is hereby directed to install and maintain official traffic signals at those intersections and other places when so directed by the Council where traffic conditions are such as to require that the flow of traffic be alternately interrupted and released in order to prevent or relieve traffic congestion or to protect life or property from exceptional hazard.

(b) The City Manager shall ascertain and determine the location where such signals, signs or markings are required by field observations, traffic counts and other traffic information as may be pertinent, and determinations therefrom shall be made in accordance with those traffic engineering and safety standards and instructions set forth in the California Maintenance Manual.

§ 3-7.405. Installation of traffic lanes, buttons and markings.

The City Manager is hereby authorized to mark center lines and lane lines and to install turning buttons, pavement warning signs, raised buttons or "reflectorized" buttons or marks to indicate upon the surface of the pavement the course to be traveled by vehicles at any place where he or she determines that such devices are advisable or necessary to foster the orderly and safe movements of traffic. Such markings and installations shall be made consistent with State law and in accordance with those standards and methods set forth in the California Maintenance Manual.

§ 3-7.406. Obedience to traffic control devices.

(a) The driver of any vehicle and the person in charge of any animal shall obey the instructions of any official traffic control devices applicable thereto placed in accordance with this chapter unless otherwise directed by a police officer, subject to the exceptions granted by Section 3-7.305 of this chapter.

(b) The driver of any vehicle and the person in charge of any animal shall obey the instructions of any barrier or sign erected pursuant to the provisions of this chapter or by any of the public departments or public utilities of the City or the County or any other person pursuant to law.

§ 3-7.407. Signs.

No provisions of this chapter for which signs or markings are required shall be enforced against an alleged violator if, at the time and place of the alleged violation, an official sign or marking is not in place and sufficiently legible and visible to be seen by an ordinarily observant person.
