§ 3-7.2401. Purpose.

The purposes of this chapter are to prohibit shared mobility devices from being placed in the public right-of-way or on public property or offered for use anywhere in the City, so as to allow for proper pedestrian and vehicular traffic flow, to promote public safety, and to provide adequate time for the City to develop a comprehensive set of regulations for regarding the offer, use and/or placement of personal mobility devices in the City.

§ 3-7.2402. Definition.

For purposes of this chapter, "shared mobility device" means any wheeled device, other than an automobile or motorcycle, that is powered by a motor; is accessed via an on-demand portal, whether a smartphone application, membership card, or similar method; is operated by a private entity that owns, manages, and maintains devices for shared use by members of the public; and is available to members of the public in unstaffed, self-service locations, except for those locations which are designated by the City.

§ 3-7.2403. General requirements.

(a) It is unlawful to park, leave standing, leave lying, abandon, or otherwise place a shared mobility device in a public right-of-way or on public property anywhere within the City.

(b) It is unlawful to provide or offer for use a shared mobility device anywhere within the City.

§ 3-7.2404. Violations.

(a) Violations of this chapter shall be punishable as a misdemeanor as provided for in Title 1, Section 2-01 of this Code.

(b) Police officers, code enforcement officials, and those City employees designated by the City Manager are authorized to impound any shared mobility device that has been offered for use, placed in a public right-of-way or on public property pursuant to the California Vehicle Code. The impound shall be subject to a shared mobility device impound and storage fee established by resolution of the City Council.

§ 3-7.2405. Procedure for retrieval of impounded shared mobility device(s).

(a) Any person wishing to recover a shared mobility device which has been impounded shall:

(1) Provide sufficient proof of ownership of the impounded shared mobility device to the Redondo Beach Police Department; and

(2) Provide proof that the requisite has been paid to the Finance Department.

(b) Any person wishing to contest the impound of a shared mobility device may submit a request in writing for an impound hearing to the Redondo Beach Police Department no later than 15 calendar days following the date of notice of the impound.
