Redlands Municipal Code Ch. 8.50 Retail Sale or Distribution of Novelty Lighters

The retail sale, offer of retail sale, gift or distribution of any novelty lighter within the territorial jurisdiction of the city of Redlands is prohibited. This prohibition is inapplicable to: a) novelty lighters which are only being actively transported through the city; or b) novelty lighters located in a warehouse or distribution center closed to the public for purposes of retail sales. "Novelty lighter" means a lighter which is especially attractive to children ten (10) years or younger due to a toylike design or other features, such as buttons or devices that initiate visual effects, flashing lights, or musical sounds that might encourage a child to use the lighter. (Ord. 2673 § 1, 2007)

The term "novelty lighter" excludes: a) any lighter manufactured prior to 1980; and b) any lighter which lacks fuel or a device necessary to produce combustion or a flame. (Ord. 2673 § 1, 2007)

The provisions of this chapter shall be enforced by the fire marshal, any police officer, any code enforcement officer, and any other city official authorized to enforce any provision of this code. (Ord. 2673 § 1, 2007)

Any person violating any provision of this chapter is guilty of an infraction. (Ord. 2673 § 1, 2007)
