7212 - Providers of solid waste services.

In order to protect public health, safety, and well-being, and to control the spread of vectors, the City Council may authorize one or more collectors to make arrangements with persons in charge of day-to-day activities at premises in the City at which solid waste is generated or accumulated, for the collection, transfer, and disposal of solid wastes within and throughout the City. The City Council, by resolution, may direct that City shall provide all or any part of these services to all or any part of the City.

7213 - Manner, time and frequency of collection.

Collectors who arrange for the collection of solid wastes shall make arrangements with their customers specifying the manner in which integrated waste management services are provided, subject to the City's duty to protect public health, safety, and well-being by prohibiting the collection of solid wastes between certain hours and on certain holidays, to control vectors and to limit sources of noise and air pollution within the City.

7214 - Categories.

In order to carry out its duties to plan for the management of vehicular traffic and mitigate adverse air quality and storm water run-off effects, the City Council may determine waste management collection categories, i.e., residential, single-family residential, multifamily residential, commercial, industrial, special, special event, household hazardous waste and other, and may make or impose franchise, license, contract or permit requirements, and service charges which may vary for such categories.

7215 - Collection arrangements required.

Responsible persons must arrange with the City for collection services as set forth in this Chapter except that responsible persons may instead self-haul solid waste generated or accumulated on premises of which they are in charge after first obtaining a self-haul permit from the City pursuant to this Chapter.

7216 - Source separation of recyclable solid waste and green waste.

Upon notice to do so by the City Manager, when determined to be necessary to protect public health, safety and well-being and to implement the policy of the State of California and the City with respect to the diversion of recyclable solid waste, green waste or both from disposal in landfills or transformation facilities, the person responsible for the day-to-day operation of each premises in the City, including but not limited to common areas of common interest subdivisions, shall segregate, cause to be segregated, or arrange for the separation of, recyclable solid waste, green waste, or both from other forms of solid waste generated or accumulated on those premises and shall place or cause to be placed the segregated recyclable solid waste, or green waste, in containers designated by the collector for the temporary accumulation of recyclable solid waste or green waste, as appropriate. The City, by resolution, may set special collection rates for collection of recyclable solid waste, green waste, or both, and for collection of containers of recyclable solid waste or green waste, or separate containers of each, which have been contaminated by excessive amounts of non-recyclable solid waste or by hazardous waste.

7216.1 - Diversion of green waste.

Each person in the City required to obtain a business license to perform gardening or landscaping services in the City for hire shall place all green waste generated or accumulated in the course of the performance of that person's gardening or landscaping services in the City into a green waste container at the premises where the green waste was generated or accumulated. If no green waste container is available on the premises where the green waste was generated or accumulated, the person performing gardening or landscaping services shall self-haul the green waste pursuant to a gardener's self-haul permit (as provided for in Section 7230, below), and deliver the green waste to a permitted green compost facility or other composting facility exempt from permitting by the California Integrated Waste Management Board, or a permitted facility serving as a collection facility for a permitted green compost facility or other composting facility exempt from permitting by the California Integrated Waste Management Board.

7216.2 - Diversion of construction and demolition waste.

Each person applying for a building or demolition permit shall submit a construction and demolition waste diversion plan to the City as part of the application. The construction and demolition waste diversion plan shall explain the measures to be implemented to divert construction and demolition waste from landfilling and to recycle or reuse construction and demolition waste to the maximum extent practicable. Each person in the City in charge of day-to-day activities at premises at which construction and demolition waste is generated or accumulated shall implement measures to divert construction and demolition waste from landfilling and to recycle or reuse construction and demolition waste to the maximum extent practicable. Persons providing bins for the temporary accumulation of construction and demolition waste in the City shall implement measures to divert construction and demolition waste from landfilling and to recycle or reuse construction and demolition waste to the maximum extent practicable.
