9-8-1: BICYCLES:¶
9-8-1-1: LICENSE REQUIRED:¶
It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets or alleys of the city without first obtaining a license which shall be issued by the fire department of the city. (Ord. 1019, 12-12-1972; amd. Ord. 1052, 2-12-1974)
9-8-1-2: APPLICATION; TERM OF LICENSE:¶
The fire department is hereby authorized and directed to issue, upon written application, bicycle licenses which shall be permanent. The licenses, when issued, shall entitle the licensee to operate the bicycle for which the license has been issued upon all the streets and alleys, exclusive of the sidewalks thereof, in the city. 9-8-1-3: LICENSE SEALS; REGISTRATION CARDS:¶
The fire department shall have an aluminum seal placed on the frame of the bicycle at the time the license is issued. (Ord. 1019, 12-12-1972; amd. Ord. 1052, 2-12-1974)
9-8-1-4: BICYCLE DEALERS; REPORTS:¶
All persons engaged in the business of buying secondhand bicycles are hereby required to make daily reports to the fire department, giving the name and address of the person from whom each bicycle is purchased, the description of each bicycle purchased, the frame number thereof, and the number of the aluminum seal found thereon. All persons engaged in the business of selling new or secondhand bicycles are hereby required to make a daily report to the fire department giving a list of all sales made by the persons, which list shall include the name and address of each person to whom a bicycle has been sold, together with a description and the frame number thereof. 9-8-1-5: SALE OR TRANSFER; REPORT:¶
It shall be the duty of every person who sells or transfers the ownership of any bicycle to report the sale or transfer by returning to the fire department the registration card issued to the person as licensee thereof, together with the name and address of the person to whom the bicycle was sold or transferred, and the report shall be made within five (5) days of the date of the sale or transfer. It shall be the duty of the purchaser or transferee of the bicycle to apply for a transfer of registration therefor within five (5) days following the sale or transfer. (Ord. 1019, 12-12-1972; amd. 9-8-1-6: DESTROYING SERIAL NUMBER OR LICENSE SEAL PROHIBITED:¶
It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate, or alter the number of any bicycle frame licensed pursuant to this chapter. It shall also be unlawful for any person to remove, destroy, mutilate, or alter any seal or registration card, during the time in which the seal or registration card is operative; provided, however, that nothing in this chapter shall prohibit the fire department from stamping numbers on the frames of bicycles on which no serial number can be found, or on which the serial number is illegible or insufficient for identification purposes. 9-8-1-7: RIDING ON SIDEWALK PROHIBITED:¶
It shall be unlawful for any person to ride a bicycle on any sidewalk in the city. (Ord. 1019, 12-12-1972)
9-8-1-8: RIDING ON PEDESTRIAN OVERPASS PROHIBITED:¶
It shall be unlawful for any person to ride any bicycle, roller skates, or any other type of wheeled vehicle on any pedestrian overpass crossing the freeway in the city. (Ord. 1019, 12-12-1972)
9-8-1-9: LIGHTING EQUIPMENT:¶
It shall be unlawful for any person to ride a bicycle on any of the streets of the city between the hours of one-half (1/2) hour after sunset and one-half (1/2) hour prior to sunrise unless the bicycle is equipped with a headlight that can be seen for a distance of at least three hundred feet (300') and with a taillight reflector that can be seen for a distance of at least two hundred feet (200'). 9-8-1-10: VIOLATION; IMPOUNDMENT OF BICYCLE:¶
Any person violating any of the provisions of sections 9-8-1-1 through 9-8-1-9 of this chapter shall be deemed guilty of a misdemeanor and in addition to any penalty imposed, the police department may impound and retain possession of any bicycle operated in violation of any of the provisions of this section 9-8-1 until the license provided for herein is obtained or any fine imposed is fully paid. 9-8-1-11: BICYCLE LANES ESTABLISHED:¶
It is hereby resolved that bicycle lanes be established and are hereby established on:
(A) Both sides of Ray Lawyer Drive from Placerville Drive to Fair Lane. (Ord. 2401, 7-11-1978)
(B) North side of Ray Lawyer Drive from Placerville Drive to Fair Lane.
Be it further resolved that the bicycle lanes hereby established shall be constructed in compliance with the provisions pertaining to bikeways in section 890 et seq., of the Streets and Highways Code. (Res. 2754, 7-22-1980)
9-8-2: SKATEBOARDS AND ROLLER SKATES ON PUBLIC WAYS:¶
9-8-2-1: RESTRICTIONS WHILE RIDING ROLLER SKATES AND SKATEBOARDS:¶
It shall be unlawful for any person upon roller skates or riding upon a skateboard, coaster, or similar device, to go upon any public street within the city limits in violation of the following restrictions:
(A) Such use shall not occur between sunset and sunrise.
(B) Persons upon roller skates or riding upon a skateboard, coaster, or similar device, shall ride as near to the right side of the roadway as practicable.
(C) No person upon roller skates or riding upon a skateboard, coaster, or similar device, shall attach the same or himself to any other vehicle.
(D) Persons upon roller skates or riding upon a skateboard, coaster, or similar device, shall yield the right of way to all motor vehicles and pedestrians.
(E) No person shall be on roller skates or ride upon a skateboard, coaster, or similar device, when approaching or upon the crest of a grade or a curve in a street where the view of such person is obstructed within such distance as to create a hazard from an approaching motor vehicle.
(F) No person shall be on roller skates or shall ride upon a skateboard, coaster, or similar device, on any street or sidewalk in a business district. The term "business district" shall have the meaning given to it by section 235 of the California Vehicle Code.
(G) Except as herein provided, any person upon roller skates or riding a skateboard, coaster, or similar device, shall be subject to all of the duties applicable to the driver of a vehicle under the California Vehicle Code, except those provisions which, by their very nature, can have no application. 9-8-2-2: OTHER RESTRICTIONS:¶
It shall be unlawful to ride or propel any skateboard, scooter, roller skate or rollerblade within or upon the following areas:
(A) Any privately owned property without the consent of the owner, provided the private property owner posts a sign that prohibits the conduct and references this section. The posting of a sign is not required for this section to apply to single-family residential property.
(B) Any public property if the property owner posts a sign that prohibits the conduct and references this section. (Ord. 1591, 1-14-2003)
9-8-2-3: PENALTY:¶
Any person who shall be convicted of a violation of any of the provisions of sections 9-8-2-1 and 9-8-2-2 of this chapter shall be deemed guilty of an infraction and may be punishable by a fine not to exceed fifty dollars ($50.00). In addition, at the time of citation, any peace officer shall have the discretion to impound the skateboard, scooter, roller skates or rollerblades as evidence pending the adjudication of the infraction, and, at the time of impoundment, shall issue the owner or operator thereof a receipt for all impounded property.
