9-4-1: REGULATION AND CONTROL OF PARKING LOTS:¶
The council may, by resolution, declare the necessity for the use of parking meters on any parking lot within the city that is municipally owned or controlled; may fix and determine traffic patterns for the movement of traffic on municipally owned or controlled parking lots and govern the ingress and egress thereto and therefrom, and adopt other resolutions for the regulation of lots, and when the council regularly passes and adopts any resolution for any purpose, the same shall control the use of the area affected thereby. 9-4-2: PARKING LOTS; PARKING RESTRICTIONS:¶
It shall be unlawful for any person on any public parking lot which is municipally owned or controlled:
(A) To park or place any vehicle on any portion of the lot in such a manner as to interfere with or restrict the freedom of traffic movement between the areas indicated for parking or to interfere with the free ingress or egress to and from said lot.
(B) To park any vehicle with a trailer or any other thing attached thereto which extends into the areas commonly used for traffic movement.
(C) To park or place any vehicle or thing on any portion of the property which has been marked in red or by pavement stripes or words or signs to indicate that no parking is permitted.
(D) To park any vehicle or thing in any manner except entirely within the area indicated for vehicular parking by parallel lines painted upon the paved surface or in any manner so that any portion of the vehicle or thing extends over or across any line painted on the paved portion of the property.
(E) To move any vehicle on any lot at any speed exceeding ten (10) miles per hour or at any speed greater than that posted at the entrance to any lot.
(F) To fail to place the name and address of the driver, the name and address of the registered owner and the registration number of any vehicle that has collided with any other vehicle or thing on the parking lot on the vehicle or thing collided with if the same be unattended, or to give such information to the person in charge of the other vehicle or thing if the same be attended.
(G) To permit any vehicle to be parked overtime or beyond any period of time declared by the council to be the maximum time for parking on such lot, whether in the same space or different spaces in the same parking lot. Any vehicle parked in violation of this section, and having been cited for that violation, is guilty of a separate and additional violation for each complete time period equal to the maximum time for parking in such lot. The fine for a violation of this section shall be as set forth in section 9-5-3 of this title.
(H) To leave any vehicle or thing in any parking stall at any time between the hours of three o'clock (3:00) A.M. and five o'clock (5:00) A.M. of any day.
(I) To park or place any truck exceeding one ton rated capacity upon any portion of any such parking lot.
(J) To drink any alcoholic beverage on the parking lot at any time of day or night.
(K) To ride or operate any skateboard, bicycle, roller skates, go-cart or any similar device not a registered and licensed motor vehicle in, or upon, any parking lot except when in conjunction with a sponsored and supervised activity sanctioned by the city.
(L) To move any vehicle in a direction contrary to a specified direction of travel as indicated by any traffic control device, arrow or other sign. (Ord. 1688, 2-28-2017; amd. Ord. 1701, 12-10-2019)
9-4-3: ISSUANCE OF CITATION FOR VIOLATION:¶
The police department, other city designated employees, or any agency or entity and its employees designated by the city council are hereby empowered to issue citations in the usual form and manner for any violations of any provisions of this chapter or chapter 3 of this title. 9-4-4: PARKING DISTRICT 1:¶
Parking district 1 is hereby declared to be from, and to be bounded as described in exhibit on file in the office of the clerk and by reference made a part hereof. The property proposed to be acquired for public parking purposes is described as follows:
Parcel 1. A parcel of land consisting of Lots 24 to 34 in Block 33, and the southwest portion of Lot 23, Block 33, having a frontage of 15.76 feet on Center Street and 7.3 feet on Hangtown Creek.
Parcel 2. A parcel of land consisting of Lot 14, Block 41; the east 12.25 feet of Lot 6, Block 41, excepting the southeast 3 feet thereof; and the portion of Lot 1 Block 41 lying northwest of the northwest line of the lands now or formerly of Otto K. Weichold.
No public ways are proposed to be acquired for ingress to or egress from said parking places.
The improvements proposed to be made or constructed on the parking places are: grading and the construction thereon of pavement, curbs, drains, lights, fences, rails, meters, and any buildings or structures necessary for the proper operation thereof; and the making of all acquisitions and the construction of all improvements and the performance of work auxiliary thereto necessary to complete same as off street parking facilities. 9-4-5: GENERAL AND HOURLY PARKING RESTRICTIONS; MUNICIPAL LOTS:¶
(A) Standard Limitations:
Unless otherwise specified below, vehicles may be parked in a municipal parking lot without charge for a period not to exceed two (2) hours. Vehicles may be parked for additional time in municipal parking lots provided payment has been made for said additional time. Municipal parking lots between the eastern terminus of Main Street at Broadway and the western terminus of Main Street shall be considered a limited time parking zone for the purposes of subsection 9-3-3(D) of this title.
No vehicle or object may be stored in any parking stall at any time between the hours of three o'clock (3:00) A.M. and five o'clock (5:00) A.M. of any day. However, overnight permits may be approved and issued by the city administration department.
Unless specified otherwise, all parking limitations shall be in effect six (6) days per week, Monday through Saturday, eight o'clock (8:00) A.M. to six o'clock (6:00) P.M., except holidays.
(B) Permit Parking Spaces:
- Permit parking shall be eight o'clock (8:00) A.M. to six o'clock (6:00) P.M., Monday through Saturday.
(C) Special Parking Limitations; Municipal Lots: The following restrictions shall be applicable to the municipal lots listed below and except as provided herein, shall be effective six (6) days a week, Monday through Saturday, eight o'clock (8:00) A.M. to six o'clock (6:00) P.M.:
- Lots:
(a) Center Street Parking Structure: Two (2) hour free parking permitted on the first and second levels. Additional time over two (2) hours may be purchased at one of the pay stations. The third level shall be reserved for leased/permit parking only. A limited amount of leased parking shall also be available on the second floor.
(b) Ivy House Lot: No vehicle or person shall be allowed on the Ivy House Lot between the hours of nine o'clock (9:00) P.M. and six o'clock (6:00) A.M., except by a permit issued through the police department for a special event or commercial activity.
(c) Mooney Lot, Milton Lot, Tetrault Lot, Fox Lot, Ivy House Lot, Old City Hall Lot : Two (2) hour free parking shall be permitted in each of these lots. Additional time over two (2) hours may be purchased at one of the pay stations. A limited amount of leased parking shall also be available in these lots.
(d) Small Center Street Lot: Two (2) hour free parking shall be permitted in this lot. In addition, a limited amount of leased parking shall also be available in this lot.
(e) Municipal lot located at the corner of Coloma and Conrad Streets: Eight (8) hour parking limit.
(f) Public Safety Building Lot: No parking shall be allowed in the Public Safety Building Lot except for persons conducting business at the public safety building.
(g) Town Hall Lot: There shall be designated two (2) parking spaces in which parking shall be limited to twelve (12) minutes and which will be reserved for the public conducting business with the community services department. Additional spaces as necessary shall be reserved for employees of the community services department. All remaining spaces shall be limited to two (2) hour free parking.
(h) Old Canal Street: Five (5) spaces adjacent to the parking lot of the business located at 209 Main Street shall be designated permit parking.
- Rates And Fees: Hourly rates for parking in excess of two (2) hours shall be by resolution of the city council. Fees for leased/permit parking shall also be set by resolution of the city council. (Ord. 1688, 2-28-2017; amd. Ord. 1701, 12-10-2019)
9-4-6: MONTHLY PARKING REQUIREMENT:¶
(A) Monthly parking fees for parking on lots owned or operated by the city shall be established by resolution of the city council.
(B) Parking permits shall be issued by the city to those persons renting a parking space on a specific interval as established by agreement between the city and the permit holder. (Ord. 1297, 3-9-1982; amd. Ord. 1537, 10-22-1996; Ord. 1701, 12-10-2019)
9-4-7: PARKING RESTRICTIONS; SIGNAGE:¶
Signs shall be posted at the entrances of all municipal parking lots setting forth applicable restrictions. (Ord. 1537, 10-22-1996; amd. Ord. 1701, 12-10-2019)
