§ 2.124.010. Purpose and scope.

This article was created to centralize Placer County Code sections related to the criminal justice functions.

§ 2.124.020. Criminal justice fees—Background.

A. The fees in this article are a result of a review by the Placer County criminal justice functional group, at the request of the county executive office, regarding legislation which allows counties to charge for specific services provided by criminal justice organizations to the general public, other agencies, inmates, probationers, or defendants going through legal or regulatory processes. The fees in this article are presented by the county department which collects the fees and are listed alphabetically by the type of service provided.

B. Legislation generally requires that fees not exceed either the actual cost of services or the average actual cost of services. Also, defendants, probationers, or inmates, generally cannot be denied services if they do not possess the required resources and therefore, a payment reduction schedule, approved by the Superior Court, must be in place when these fees are recommended. Should the defendant not agree to the fees and the county feels he or she has sufficient funds to pay the costs or a part thereof, he or she can request a court hearing to establish the ability to pay. Thus, placing the decision in the hands of the court.

This is not an inclusive set of all fees charged by the Placer County criminal justice departments. It only lists fees that need to be established by county ordinance. Some of the services listed are discussed in detail in other sections of the Placer County Code as indicated. Background information regarding the following services, respective legislation, and the recommended fees are available at the related county departments and are also on file with the approved county ordinance.

§ 2.124.030. Health and human services fees.

The alcohol and drug assessment fee is contained in Section 2.116.110.[1]

This fee is subject to the ability to pay. The fee charged shall not exceed the maximum amount indicated in the published fee schedule.

§ 2.124.050. Sheriff/coroner/marshal fees.

1. Alarm Activation:
a. Second activation $ 25.00

5. Concealed Weapon License—New: 2

A $3.00 process fee for the county is set by the state.
6. Concealed Weapon License—Renewal: 2

$100.00 for new permits and $25.00 for renewal permits process fee for the county is set by the state. The additional $20.00 is for the rolling fee for fingerprints. Licensee must attend a gun safety class every 5 years.

12. Emergency response restitution Varies
Actual emergency response costs related to a DUI or negligent operation of a vehicle, boat, or airplane incurred by county departments are billed back to the responsible party. The fee must not exceed $1,000.00 per incident.

17. Impound Vehicle Release Fee—Tow Company:
a. Administrative service fee 75.00
b. Hearing fee, included in administrative service fee. (also see Section 10.12.150 of this code)
For vehicles held by tow companies as a result of Vehicle Code Section 14607 (30-day hold for driving on a suspended or revoked license. A hearing can be requested to obtain early release.)
18. Inmate Medical Fee: 1
a. Health service request $ 3.00
b. Over-the-counter medications Inmates co-pay for each initiated health service request or over-the-counter medication. No one is ever denied treatment due to lack of ability to pay. 0.50 each request
19. Law Enforcement Services Varies
Other local law enforcement agencies requesting specialized services from the sheriff's department will be charged for the actual cost of the services provided. Services include, but are not limited to, assistance with crime scene and homicide investigations, and assistance with public events.

28. Coroner's Custody Fee 3 (includes $150.00 transportation fees plus $10.00 for materials) 160.00 or up to maximum as allowed per PC based on actual costs

2 This service also requires that an established estate and/or federal fee be collected by the county and forwarded to the state and/or federal government. The state and federal fees are not stated in the Placer County Code as they are established by the state and federal legislation.
3 This fee will not be charged for indigents, children under 14 years of age or death as a result of a criminal act of another unless the coroner has reasonable grounds to believe that the deceased was involved in any criminal activity which contributed to his or her death.

§ 2.124.060. Indigent public defense program fees.

A. All indigent public defense program defendant reimbursement of legal fees are subject to a financial evaluation of defendants' ability to pay those fees, either in whole or in part, pursuant to Penal Code Section 987.8.

B. Registration fee for indigent public defense request (nonrefundable)—$25.

C. Indigent Public Legal Defense Defendant Reimbursement Fees.
