12.18.010 - Title.

This chapter shall be known and may be cited as the "Signalization Fee Ordinance."

12.18.020 - Purpose.

The purpose of this chapter is to assess fees to developments in the city based on the expected generated traffic, to be used for signalization of arterial street intersections and the provisions of other traffic-control devices throughout the city.

12.18.030 - Definitions.

"A.D.T." means average daily traffic.

"Arterial Street" means any street listed on the circulation element of the general plan as an arterial street or in the judgment of the city engineer a street functioning as an arterial street.

"Trip Generation Handbook" means the Trip Generation Report published by the Institute of Transportation Engineers 1976 and all addendums and revisions.

12.18.040 - Issuance of regulations and setting of fees.

The city council may, from time to time by resolution, issue regulations and set fees for the implementation of this chapter.

12.18.050 - Policy.

The city of El Paso de Robles does hereby officially establish the following policies in regards to traffic signalization fees:

Policy 1. Traffic signalization of arterial street intersections is generally to the benefit of all citizens of El Paso de Robles and as such, new development within the city shall share in a portion of signalization costs in direct relationship to the traffic expected to be generated by the development.

Policy 2. The need for signalization at locations other than arterial intersections is generally created by and for the primary benefit of the development adjacent to that location, whose full access street or driveway intersects with a major city street. If the development did not exist, or if a full access street or driveway was not allowed, no traffic signal would be required. Therefore, if the city engineer determines that a traffic signal may be warranted, the developer is required to construct the subject signal bearing the full cost of the installation.

Policy 2 is not intended to delete any fees required under Policy 1.

12.18.060 - Standards for fees.

Any fees imposed pursuant to this chapter shall bear reasonable relationship to the costs associated with intersection signalization requirements caused by developments.

12.18.070 - Fee required.

When fees are required by resolution of the city council, such payment shall be made at the time of request for building permit.

12.18.080 - Account.

Fees received pursuant to this chapter shall be paid to a traffic signalization fund and used exclusively for installation or modification of traffic signals systems, traffic signing or striping.
