Chapter 12.58 — BICYCLES

It is unlawful for any person, firm or corporation to operate or use a bicycle, propelled wholly or in part by muscular power, upon any of the streets, alleys, or public highways of this city without first obtaining from the police department of the city a license therefor.

The police department is authorized and directed to issue, upon application therefor, which shall be in writing, bicycle licenses which shall be effective for three-year intervals, the first term to expire December 31, 1978. Thereafter such licenses shall be issued for the current three-year term. Such licenses when issued shall entitle the licensee to operate the bicycle for which such license was issued, upon all the streets, alleys and highways (exclusive of sidewalks and parks) in the city.

Each person shall be allowed a period of thirty days after January 1st of the year in which the license expires to obtain his license, after which time a penalty of one dollar shall be imposed and collected.

The city shall provide license plates, together with registration cards. Such license plates shall be suitable for attachment upon the frames of bicycles, and it shall be the duty of the police department to attach one such license plate to the frame of each bicycle and to issue a corresponding registration card to the licensee upon the payment of the license fee required in this chapter, together with penalty if incurred. Such license plate shall remain attached during the existence of such license. The police department shall also keep a record of the date of issue of each license, to whom issued and the number thereof.

Each bicycle shall carry reflectorized parts and attachments as required by state law.

All persons engaged in the business of buying secondhand bicycles are required to make daily reports to the police department of the city, giving the name and address of the person from whom each bicycle is purchased, the description thereof, the frame number, and the number of the metallic license plate found thereon, if any. All persons engaged in the business of selling new or secondhand bicycles are required to make daily reports to the police department, giving a list of all sales made by such dealer, which list shall include the name and address of each person to whom sold, the kind of bicycle sold, together with a description and frame number thereof, and the number of the metallic plate attached thereto, if any.

It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer to the police department by returning the registration card issued to such person as licensee thereof, together with the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made within five days from the date of such sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply for a transfer of registration therefor within five days of such sale or transfer.

It is unlawful for any person to willfully or unlawfully remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this chapter. It is also unlawful for any person to remove, destroy, mutilate or alter any license plate, seal or registration card during the time in which such license plate, seal or registration card is operative; provided, however, that nothing in this chapter shall prohibit the police department from stamping numbers on frames of bicycles on which no serial number can be found, or upon which said number is illegible, or insufficient for identification purposes.

The license fee to be paid for each bicycle shall be one dollar per year and shall be paid in advance, and pursuant to Section 12.58.070, such license may be transferred when the ownership of said bicycle is transferred, and a fee of one dollar shall be paid for the registration of such transfer. All license fees collected under this chapter shall be used as provided in the Government Code.

Any person who is convicted of violating any provisions of this chapter is guilty of an infraction punishable by (a) a fine not exceeding fifty dollars for a first violation, (b) a fine not exceeding one hundred dollars for a second violation of same ordinance within one year, (c) a fine not exceeding two hundred fifty dollars for each additional violation of the same ordinance within one year. In addition to the penalty hereinabove provided for, the police department, or any member thereof, may impound and retain possession of any bicycle operated in violation of the provisions of this chapter, and retain possession of the same until the license provided for in this chapter is obtained by the owner of such bicycle.
