Chapter 13.08 — ENERGY USE CONSERVATION

13.08.010 - Outdoor advertising and decorative lighting.¶
Except as herein otherwise provided, no person, firm or corporation in the city shall at any time make, cause or permit any use of electrical energy for lighting of billboards, signs, advertising goods or services, or to identify the providers of goods or services, displays of goods, objects or designs symbolic of commercial enterprises, trademarks or logo, or motors or devices to rotate or move advertising signs or operate pumps or other devices in fountains which are primarily decorative, building floodlighting, architectural or decorative lighting, or lights used for landscaping, or any similar form of lighting based upon the use of electrical energy.

13.08.020 - Window and display lighting—When.¶
Notwithstanding the provisions of Section 13.08.010, each business establishment may operate its window and display lighting and illuminate 2 outdoor signs between the hours of sunset and ½ hour after closing or 10:30 p.m., whichever is later, and each billboard may be illuminated between the hours of sunset and 10:30 p.m. Each business establishment may operate time/temperature signs and, during its normal business hours, operate decorative fountains without lighting and devices to rotate or move advertising signs. Each year between Thanksgiving Day and New Years Day, Christmas decorations may be illuminated between the hours of sunset and ½ hour after closing or 10:30 p.m., whichever is later.

13.08.030 - Window and display lighting—Decreased.¶
When the provisions of Section 13.08.020 are suspended, each business establishment may operate its window and display lighting and illuminate 1 outdoor sign between the hours of sunset and ½ hour after closing or 10:30 p.m., whichever is later, and each billboard may be illuminated between the hours of sunset and 10:30 p.m.

13.08.040 - Functional outdoor lighting—During day.¶
Except as herein otherwise provided, no person, firm or corporation in the city shall make, cause or permit any use of electrical energy for the floodlighting of outdoor commercial areas including, but not limited to, service stations, used car lots, new car lots, automobile parking lots or similar businesses between the hours of sunrise and sunset and when not open for business.

13.08.050 - Functional outdoor lighting—Safety purposes.¶
Notwithstanding the provisions of Section 13.08.040, prohibited uses of electrical energy are not applicable to that minimum lighting necessary for public safety or for security, or that required by law, or required for the lighting of essential buildings utilized for police, fire protection, health and communications purposes.

13.08.060 - Indoor business lighting—During open hours.¶
No person, firm or corporation in the city shall make, cause or permit the use of electrical energy for lighting the interior of any commercial or industrial establishment during any period that the establishment is not carrying on the usual and customary activities of that business.

13.08.070 - Indoor business lighting—Safety purposes.¶
Notwithstanding the provisions of Section 13.08.060, a commercial or industrial establishment may provide sufficient illumination at all times to provide a minimal level of protection and security to persons and property.

13.08.080 - Indoor business lighting—Maintenance work.¶
Nothing in Sections 13.08.060 and 13.08.070 shall be construed to prohibit ordinary and customary maintenance and janitorial services at times other than those during which the establishment is carrying on the usual and customary activities of that business.

13.08.090 - Air conditioning and appliances.¶
No person, firm or corporation in the city shall make, cause or permit the use of electrical energy for air conditioning, heating, cooling or operation of appliances in any commercial or industrial establishment during any period that the establishment is not carrying on the usual and customary activities of that business, unless such use is required by law or is essential to provide necessary services and reasonable temperatures during business operations or for the protection of temperature sensitive goods, wares, merchandise or operations. Where it is not established that a net energy savings can be achieved by operating space conditioning equipment during nonbusiness hours, such equipment shall be turned off.

13.08.100 - Demonstrating electric appliances.¶
No person, firm or corporation in the city shall make, cause or permit the use of electrical energy for more than 2 demonstration electric appliances at any 1 time, except when such appliances are actually being demonstrated to a specific customer.

13.08.110 - General use reduction.¶
Effective upon the adoption of the ordinance codified herein all users of electrical energy shall reduce the amount of electrical energy consumed by them. The board of directors shall establish by resolution from time to time the percentage of consumer reduction to be applied and the manner thereof.

13.08.120 - Civil penalty for noncompliance.¶
Any person, firm or corporation, who fails to comply with this chapter shall have his electric service disconnected until such compliance is attained. Before electric service is disconnected for noncompliance, the general manager of the water and power department shall give such customer written notice that service is to be disconnected for violation of this chapter and that the customer has a right to a hearing before the general manager of the water and power department, or his authorized representative, within 10 days of the date the notice is mailed or personally delivered to the customer. In the event the customer requests such a hearing, disconnection of service shall be stayed until completion of the hearing.

13.08.130 - Criminal penalty for violation.¶
Any person violating any of the provisions of this chapter is deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than $500.00 or by imprisonment for a period of not more than 6 months, or by both such fine and imprisonment. Each separate day during which any violation of this chapter occurs or continues is deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided.

13.08.140 - Suspension of provisions.¶
The board of directors may, by resolution, suspend the provisions of this chapter or any section or subsection hereof for such period of time as it deems to be in the public interest.
