Chapter 12.15 — POSTING ON PUBLIC PROPERTY

No person, except a public officer or employee in the performance of a public duty, shall paint, post, paste, print, nail, stamp, tack or otherwise fasten any card, banner, handbill, sign, sticker, poster or advertisement, notice or advertising device of any kind calculated to attract the attention of the public or cause the same to be done on any curbstone, curb, lamppost, pole, hydrant, bridge, wall or tree, or upon any fixture or fire alarm, police or telephone system of the city, or upon any public sidewalk, street, alley or other public place except as may be required by ordinance or law, or to construct or maintain any sign or sign device upon any sidewalk, street, alley or other public place except as any be permitted or required by the Constitution of the United States or the state of California, any statute or any ordinance. Provided, however, that no banners or pennants shall be permitted nor posters or signs composed of paper or cardboard.

Notwithstanding any provision of this code to the contrary, it is lawful for any person, upon obtaining a permit from the city manager, issued in the manner and under the conditions hereinafter provided, to erect, construct and maintain upon the public sidewalks, streets and other public places of the city, so as not to interfere with traffic or the safety of persons and property, and in such manner as the city manager shall determine, decorative flags, emblems, banners, bunting, shrubbery and other similar devices, when such decorative devices are erected, constructed and maintained by the direction of and with the consent of the persons producing in the city a festival, spectacle or other similar events of a general civic and public nature, and when such decorative devices are erected, constructed and maintained in conjunction with and pertain to such festival, spectacle or other civic event.

The city manager is authorized and directed to issue to such persons who or which are in charge of the production of a festival, spectacle or other similar event in the city of a general civic and public nature, and who or which file a written application therefor, a temporary permit to erect, construct and maintain upon the public sidewalks, streets and other public places of the city, in such manner as the city manager shall determine, such decorative flags, emblems, banners, bunting, shrubbery and other similar devices as will not interfere with traffic or the safety of persons or property, and such as are in conjunction with and pertain to such festival, spectacle or other similar civic event. Such temporary permit shall designate thereon the dates during which such decorative devices may be so erected, constructed and maintained; and such period of time shall be for not more than 5 days after the period during which such festival, spectacle or other civic event is produced in the city.

A.

No portion of any sign nor of its supports shall be so placed that it will in any way obstruct any fire escape, stairway or standpipe, nor shall any such sign or any of its supports be attached to or supported by any fire escape, nor shall it obstruct access to any fire escape or stairway.

B.

No portion of any sign or of its supports shall be so placed that it will interfere with human exit through all the windows of any rooms located above the 1st floor of any building.

C.

No portion of any sign or of its supports shall be so placed that it will obstruct any exterior door or required exit of any building.

D.

No sign shall be so placed that it will obstruct any legally required light and ventilation.

It is unlawful for any person to erect, construct or maintain a sign of any kind or character for the purpose of advertising the wares, goods, merchandise or business of any such person when such advertising structure or sign displays or makes use of the words, "stop," "look," "danger," or any other word, phrase, symbol or character in such a manner as to interfere with, mislead or confuse traffic.
