2.46.010 - Declaration of necessity—Paradise Redevelopment Agency.¶
It is hereby found and declared, pursuant to Section 33101 of the Community Redevelopment Law, constituting Part 1 of Division 24 of the California Health and Safety Code, that there is a need for the redevelopment agency created by Section 33100 of the Community Redevelopment Law to function in the town, and such agency is hereby authorized to transact business and exercise its power under the Community Redevelopment Law. Such agency shall be known as the "Paradise Redevelopment Agency" (the "agency"). (Ord. 374, § (part), 2002)
2.46.020 - Town council to act as agency.¶
Pursuant to California Health and Safety Code Section 33200, the town council of the town hereby declares itself to be the agency, with all the rights, powers, duties, privileges and immunities vested by the Community Redevelopment Law. It is hereby found that this action will serve the public interest and promote the public safety and welfare in an effective manner. (Ord. 374, § (part), 2002)
2.46.030 - Declaration of need for redevelopment agency.¶
Pursuant to Section 2.46.010 of this Code, the council of the Town of Paradise declared the need for redevelopment agency in the Town and established the Paradise Redevelopment Agency. (Ord. 390, § 1, 2003)
2.46.040 - Appointment of board of directors of redevelopment agency.¶
Pursuant to Section 2.46.020 of this Code, the Council of the Town of Paradise declared itself to be the board of directors of the Paradise Redevelopment Agency. (Ord. 390, § 2, 2003)
2.46.050 - Remuneration for board of directors of redevelopment agency.¶
The board of directors of the Paradise Redevelopment Agency shall not be remunerated. (Ord. 390, § 3, 2003)
2.46.060 - Seal.¶
The executive director of the Paradise Redevelopment Agency is hereby authorized to obtain the seal of the agency which shall include the name of the agency and the year of its establishment. (Ord. 390, § 4, 2003)
2.46.070 - Officers.¶
The officers of the Paradise Redevelopment Agency shall be a chairperson, vice-chairperson, executive director, deputy executive director, secretary, treasurer and agency counsel who shall be the Mayor, Vice-Mayor, Town Manager, Assistant Town Manager, Town Clerk, Finance Director, and Town Attorney respectively. 2.46.080 - Other agency personnel.¶
The executive director of the agency may appoint, designate, or assign a Town employee to serve the agency in various professional capacities for redevelopment related projects and programs. (Ord. 390, § 6, 2003)
2.46.090 - Duties of officers and other agency personnel.¶
The duties of the officers and other personnel of the Paradise Redevelopment Agency shall be as provided by law, as adopted by resolution of the board of directors and as promulgated by the executive director when not in conflict with the provisions of this chapter. (Ord. 390, § 7, 2003)
2.46.100 - Meetings.¶
All meetings of the Paradise Redevelopment Agency shall be held at the times and in the manner established for meetings of the Town Council, or at such other times as may be determined by the board of directors of the agency. (Ord. 390, § 8, 2003)
2.46.110 - Quorum.¶
A majority of the board of directors of the Paradise Redevelopment Agency shall constitute a quorum for the transaction of business. (Ord. 390, § 9, 2003)
2.46.120 - Minutes of meetings.¶
The secretary of the Paradise Redevelopment Agency shall be responsible for minutes of all meetings of the agency. (Ord. 390, § 10, 2003)
2.46.130 - Agency address.¶
The mailing address and office address of the Paradise Redevelopment Agency shall be the mailing address and office address of the Town Clerk of the Town of Paradise. (Ord. 390, § 11, 2003)
2.46.140 - Personnel rules and policies.¶
The Paradise Redevelopment Agency's personnel rules and policies shall be the same as those for the Town of Paradise. (Ord. 390, § 12, 2003)
2.46.150 - Environmental review guidelines.¶
The "Environmental Review Guidelines" of the Town of Paradise, as set out in Town Council Resolution No. 00-14, are adopted as the Paradise Redevelopment Agency's guidelines for evaluating projects and the preparation and review of environmental documents, except that the agency shall be deemed the lead agency under the California Environmental Quality Act (CEQA) and shall certify the final environmental impact report for a proposed redevelopment plan and subsequent environmental documents, if any, for proposed projects for which approval of the agency is required. (Ord. 390, § 13, 2003)
2.46.160 - Investment of moneys in Local Agency Investment Fund.¶
A. The Paradise Redevelopment Agency is hereby authorized to deposit and withdrawal of agency moneys in the Local Agency Investment Fund in the State Treasury.
B. The executive director and the treasurer of the agency, or their designees, are authorized to order the deposit and withdrawal of such money in the Local Agency Investment Fund. (Ord. 390, § 14, 2003)
2.46.170 - Conflict of interest.¶
The Paradise Redevelopment Agency's conflict of interest code shall be the same as the one for the Town of Paradise. (Ord. 390, § 15, 2003)
2.46.180 - No power of eminent domain.¶
The Paradise Redevelopment Agency shall not acquire any real property by eminent domain. (Ord. 390, § 16, 2003)
