10.15.010 - Purpose and intent.¶
A. The purpose of this chapter is to regulate the movement of certain commercial vehicles through the town.
B. The intent of this chapter is to provide increased safety for the residents of the town by prohibiting certain commercial through traffic on all public streets except as provided in Section 10.15.050 and to increase the usable life of town roads where traffic will be decreased. 10.15.020 - Definitions.¶
The following words and phrases have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
"Commercial vehicle" means any vehicle as defined in the California Vehicle Code Section 260 having a gross vehicular weight of twelve thousand pounds or more.
"Public road" means a right-of-way and road surface owned and maintained by the town.
"Truck route" means a designated route for through commercial vehicles exceeding twelve thousand pounds gross weight. (Ord. 346 §1(part), 2000)
10.15.030 - Established.¶
The town council shall adopt a resolution establishing one or more truck routes through the town as shown on that certain map herein known as the truck route map for the town. The truck route map shall be kept on file in the office of the town engineer. (Ord. 346 §1(part), 2000)
10.15.040 - Procedure.¶
A. When a truck route is established over any public road the town engineer shall have installed appropriate "Truck Route" signs along the road.
B. The operator of any commercial vehicle which exceeds twelve thousand gross pounds in weight shall drive on the designated truck route and no other street, except for picking up and delivering within the town.
C. Also, nothing in this section will prohibit an commercial vehicle owner/operator from using nontruck route streets when necessary to go to and from his primary place of residence, provided the truck is not carrying a load. (Ord. 346 §1(part), 2000)
10.15.050 - Exceptions.¶
The provisions of this chapter do not apply to:
A. Passenger buses under the jurisdiction of the public utilities commission; or
B. Any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility.
C. Any commercial vehicle engaged in or under contract to a Public Works Project, as defined in Section 1720 of the California Labor Code. (Ord. 346 §1(part), 2000)
10.15.060 - Violation—Penalty.¶
Any operator of any vehicle which exceeds a gross weight of twelve thousand pounds which drives on nontruck route streets, except as provided in Section 10.15.050, is guilty of an infraction punishable as provided by Government Code Section 36900. (Ord. 346 §1(part), 2000)
