Chapter 9.50 — CURFEW — Paradise Municipal Code

9.50.010 - Curfew rules.¶

It is unlawful for any minor under the age of eighteen years who is unaccompanied by his or her parent, guardian or other adult person having legal care or custody of the minor, to loiter, idle, wander or remain on the following property or places between the hours of ten p.m. (Pacific Standard Time) or eleven p.m. (Pacific Daylight Savings Time, whichever is in effect) of any day and five a.m. (Pacific Standard Time or Pacific Daylight Time, whichever is in effect) of the following day:

Any public street, sidewalk, parking lot, park or other public place, except where such minor is performing an emergency errand directed by his or her parent, guardian or other adult person having legal care and custody of the minor, is required to be in or upon a public place incidental to his or her lawful employment, or is directly and actively proceeding to his or her place of residence or to or from a public meeting or place of business, worship, education, entertainment or recreational activity;

Any private property used for a commercial purpose, unless such minor is lawfully employed on such private property, actively engaged in patronizing a business located on such private property, or is present on such private property with the express consent of the owner. Each violation of the provisions of this section shall constitute a separate offense.

9.50.020 - Violation—Application of juveniles court law to minor.¶

Any minor violating section. 9.50.010 shall be guilty of an infraction and shall be dealt with in accordance with the provisions of the law of the state.

9.50.030 - Application to parent or guardian.¶

It is unlawful for the parent, guardian or other adult person having legal care and custody of a minor under the age of eighteen years, to permit or allow such minor to loiter, idle, wander or remain on the following property or places between the hours of ten p.m. (Pacific Standard Time) or eleven p.m. (Pacific Daylight Savings Time, whichever is in effect) of any day and five a.m. (Pacific Standard Time or Pacific Daylight Savings Time, whichever is in effect) of the following day:

9.50.040 - Violation punished as an infraction.¶

A violation of Section 9.50.030 shall constitute an infraction. Each violation of the provisions of this chapter shall constitute a separate offense.
