Chapter 10.02 — SPEED LIMITS — Paradise Municipal Code

10.02.010 - Findings.¶

The town council, upon the basis of engineering traffic surveys, expressly finds that the prima facie speed limits, as set forth in Sections 10.02.060 through 10.02.100, upon those certain designated portions of public highways designated in Sections 10.02.060 through 10.02.100, are more than is reasonable and safe and that the prima facie speed limits upon the portions of the public highways designated in Sections

10.02.060 through 10.02.100 are most appropriate to facilitate an order and movement of…¶

reasonable and safe.

10.02.020 - Adoption.¶

The town council declares that this chapter is adopted pursuant to the authority granted it by Section 22358 of the Vehicle Code of the state.

10.02.030 - Purpose.¶

The purpose of this chapter is to safeguard life and property and to implement modifications recommended by a traffic safety study providing certain speed zones along specified public roads.

10.02.040 - Definitions.¶

The following words or phrases have the meanings ascribed to them within this chapter:

"Public road" means any right-of-way and road surface owned in fee by the town, or that is maintained by the town on a regular basis.

"Speed zone" means a portion of a public road along which a specified maximum vehicular speed has been determined and posted by the town council.

"Vehicle" means a device in, upon or by which any person or property may be propelled, moved or drawn upon a highway, excepting a device moved by human power or used exclusively upon stationary rails or tracks. (Ord. 84 §4, 1983)

10.02.050 - Designated.¶

The town council establishes certain prima facie speed limits on certain public highways of the town as designated in Sections 10.02.060 through 10.02.100.

10.02.060 - Prima facie speed limit.¶

The town council establishes a prima facie speed limit of twenty-five (25)miles per hour for all town maintained public roads not listed or otherwise set forth in this chapter.

In accordance with Vehicle Code Section 22352, the following established school zones shall have a prima facie speed limit of twenty-five (25) miles per hour anytime children are present:

Buschmann Road, from Scottwood Road to Clark Road.

Pearson Road, from Academy Drive to Clark Road.

Recreation Drive, from Buschmann Road north five hundred thirty (530) feet (to end of town maintained road).

Maxwell Drive, from Elliott Road to Central Park Drive.

Pentz Road, from Merrill Road to Dean Road.

Pentz Road, from Bille Road to Wagstaff Road.

The town council also establishes posted speed limits on certain highways as follows:

10.02.110 - Signs—Authority of town engineer.¶

Provisions of this chapter shall not be effective until appropriate signs, giving notice of the prima facie speed limits, are erected on the road within the limit specifically designated in this chapter, in each particular instance.

It is made the duty of the town engineer to erect appropriate signs giving notice of the speed limits upon portions of the public roads designated in this chapter.

10.02.120 - Violations.¶

It is unlawful for any person, firm or corporation to drive or cause to be driven any vehicle upon those portions of public highways designated in Sections 10.02.060 through 10.02.100 in excess of the prima facie speed limits provided for.
