Article II — PARKING ON PROPERTY NOT DESIGNATED AS TRAILER CAMP

For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:

A.

"Camp space" means any place temporarily maintained by one or more persons for living or sleeping purposes.

B.

"Health officer" includes the health officer of the county, and all members of the department of health of the county.

C.

"Police department" includes the chief of police of the town, and his duly authorized police officers.

D.

"Trailer coach" means any camp car, trailer or other vehicle, with or without motive power and designed for or used for human habitation but excluding trailers or mobile homes in excess of eight feet in width. (Ord. 75 §1(A, B)(part), 1982; Ord. 16 §1(Q)(part), 1980: county code §22-4)

A.

The police department or health officer shall enforce all the provisions of this article and shall inspect all accommodations and installations subject to this article.

B.

The health officer is authorized to issue or deny written permits required by this article.

C.

Requests for permits shall be directed to the health officer, who may require proof that the applicant has the permission of the owner or person legally in charge of the real property upon which a permit is requested.

D.

If the findings of the health officer are such that the issuance of a permit would be detrimental to the health of any person or adversely affect the sanitary conditions of the area, he shall deny the application and not grant the permit. Permits shall not be transferable and shall expire upon the date of expiration endorsed thereon.

E.

The health officer shall, upon the issuance of any permit, forthwith transmit a copy thereof to the police department. (Ord. 75 §1(A)(part), 1982; Ord. 16 §1(Q)(part), 1980: county code §22-5)

A.

No person shall park any trailer coach on public or private property within the town for a period in excess of five days in any consecutive thirty days without first having obtained a permit as provided in this article, except in an approved trailer camp or labor camp.

B.

No person shall occupy any camp space on public or private property in the town for a period longer than five days after notification in any thirty consecutive days without first having obtained a permit as provided in this article. (Ord. 16 §§1(Q)(part), 2(B)(part), 1980: county code §22-6)

Any permit issued under the provisions of this article may be revoked for just cause by the health officer. Notice of revocation shall be made verbally to the valid holder of the permit and within forty-eight hours of service of notice an affidavit attesting to such service shall be filed with the town clerk and be made of record. The permit shall be considered revoked within five days of such service. (Ord. 75 §1(I)(part), 1982; Ord. 16 §1(Q)(part), 1980: county code §22-7)

A.

The provisions of this article shall not be construed to apply to any trailer coach or camp site referred to in an act regulating auto and trailer parks, Division XIII, Part II, Health and Safety Code, nor in an act regulating camps where five or more persons are employed, Division II, Part IX, Chapter I of the Labor Code; nor shall this article be construed to apply to any supervised public park or public camp or picnic ground operated or maintained by the federal government, the state or any agency of the state nor by any political subdivision or municipality.

B.

The provisions of this article do not apply to any trailer coach parked in dead storage and not used for living or sleeping purposes. (Ord. 16 §1(Q)(part), 1980: county code §22-8)
