Chapter 5.13 — SOLICITORS

"Solicitor," as used in this chapter, means any person and each individual person, whether working for himself or another person, who goes from house to house or from place to place in the town selling or taking orders for or offering to sell or take orders for, goods, wares or merchandise or any other article, for services to be performed or for the making, manufacturing or repairing of any article or thing whatsoever; provided, that this definition shall not apply to or include representatives of wholesalers, manufacturers or jobbers taking orders from or selling directly to local merchants, businesses or professions maintaining a fixed place of business, as defined in subsection C of Section 5.01.030. It shall be unlawful to engage in the business of a solicitor in the town without first obtaining a business license and paying a fee for such license as shall be determined by council resolution. (Ord. 129 §5.13.020, 1985)

All orders taken by any solicitor shall be in writing, in duplicate, stating the terms thereof and the amount received in advance by the solicitor. One copy shall be given to the purchaser at the time the order is taken and the deposit paid. (Ord. 129 §5.13.030, 1985)

A solicitor's business license shall be valid until December 31st of the year next succeeding the year in which said solicitor's special business license is issued. (Ord. 129 §5.13.040, 1985)

Any person required to have a license under this chapter shall make application therefor to the police department upon such application form as may be prescribed, from time to time hereafter, by the town manager. Such application shall set forth the following information: name, address, personal description, nature of business, name and address of employer or supplier of goods to be sold, duration of solicitation, and prior felony convictions, if any, and any other pertinent information as required by the police department. The applicant upon compliance with Section 5.13.010 shall be registered, unless the applicant has prior felony conviction, in which case the chief of police may deny registration, and the applicant may appeal to the town council. (Ord. 129 §5.13.060, 1985)

Upon approval of the application and the receipt of the required fees, the police department shall issue an identification card in the name of the individual solicitor. The identification card shall contain the following information: a picture and the full name of the solicitor, date of birth, the company, firm or organization represented, the date of issuance and the date of expiration. The identification card of each solicitor shall be displayed and affixed to the outermost garment in the area of the left breast pocket at all times whenever the person is soliciting. (Ord. 129 §5.13.080, 1985)

It shall be unlawful to use or display a solicitor's identification card which has been issued in the name of another. (Ord. 129 §5.13.090, 1985)

The solicitor's identification card must be surrendered to any Paradise police officer upon request. (Ord. 129 §5.13.100, 1985)

Any person soliciting within the town shall conform to the following regulations:

A.

Solicitation is to be done in an orderly and lawful manner.

B.

Solicitation is limited to the hours of nine a.m. to five p.m. or until sunset, whichever is earlier. (Ord. 129 §5.13.110, 1985)

When a solicitor represents or is sponsored by a charitable or nonprofit organization based within the boundaries of the town, the town council may grant a license to this organization without payment of a fee. (Ord. 129 §5.13.120, 1985)
