Sec. 6-6.701. - Lists: Preparation and recordation.

As an alternative method of collecting any of the sewer charges set forth in Article 4 of this chapter, the City Clerk may prepare and record with the County Recorder a list of all delinquent sewer charges at least every six (6) months; provided, however, no delay or informality in the recording of such list shall invalidate the lien of any unpaid charge or any subsequent act or proceeding.

Sec. 6-6.702. - Lists: Form.

The list provided for in Section 6-6.701 of this article shall state the amount of each delinquent sewer charge, the penalties thereon, a description of the property upon which the same is a lien, and that the lien is payable to the City.

Sec. 6-6.703. - Lists: Effect of recordation.

The list of delinquent charges shall effect a lien upon the several parcels of property contained therein as of the date of recording, and property may be discharged therefrom within one year thereafter by the payment of all delinquent charges and penalties.

Sec. 6-6.704. - Liens: Effect and enforcement.

When the list of delinquent sewer charges is recorded and becomes a lien, such lien shall have the force, effect, priority, and duration as to the property described as would a lien or an abstract of judgment against the owner of real property and may be enforced in like manner.

Sec. 6-6.705. - Liens: Errors.

If, through error or otherwise, the amount of any unpaid sewer charge, plus penalties thereon, as stated in the list of delinquent sewer charges, is increased, such error shall be disregarded and shall not affect or invalidate the filing if the error for any parcel is the sum of One and no/100ths ($1.00) Dollar or less.

Sec. 6-6.706. - Liens: Enforcement by court action.

As an alternative remedy, the City may bring an action to enforce the lien of the sewer charges and all penalties, including reasonable attorneys' fees.
