Chapter 3.28 — CULTURAL ARTS COMMISSION

§ 3.28.010. Standards.¶

The standards which shall guide the cultural arts commission in performing its duties and functions under this chapter are as follows:

(a) The citizens of Pacific Grove are concerned that the visual, literary, and performance arts be an integral part of the life of the city.
(b) The decisions concerning the arts in Pacific Grove should be part of city government in order to better support, promote, facilitate, and coordinate these arts within the city.
(c) Artists and art admirers in the community should have a greater voice and participation in artistic matters within the city.

§ 3.28.020. Creation – Membership.¶

A cultural arts commission for the city of Pacific Grove is created. The commission shall consist of five voting members appointed by the mayor and approved by the council.

§ 3.28.030. Member qualifications.¶

One member of the commission shall be active in the literary arts, one member shall be active in the visual arts, one member shall be active in the performance arts, and the remaining two members shall be interested in, connected with or knowledgeable about the arts. (Whenever possible, the council shall consider appointing a high school student as one of the "remaining two" members.) Provided, that should the council determine that no person is available to fill a position requiring a specified qualification, the council may appoint a person interested in, connected with or knowledgeable about the arts. The members of the commission should represent all the arts, insofar as possible.

§ 3.28.040. Terms designated.¶

All appointees shall serve for a two-year term. Three of the commission members shall be appointed for terms ending on January 31st in odd-numbered years, and two of the commission members shall be appointed for terms ending on January 31st in even-numbered years. § 3.28.050. Removal of members.¶

Any member may be removed from the commission prior to the expiration of his or her term by majority vote of the council, in the council's discretion. Any member who absents himself or herself from two consecutive regular meetings, without approval for good cause by the commission, shall be automatically removed from the commission. § 3.28.060. Selection of chairperson.¶

The voting members of the commission shall select one of the membership to be chairperson for a one-year term, the chairperson to be selected and the term to commence at the first meeting in February.

§ 3.28.070. Time and place of meetings.¶

All meetings of the commission shall be open to the public, and the commission shall meet no less frequently than once a month and shall establish its own rules for the frequency, time and place of meetings and to govern its procedures. Notice of meetings shall be given as required by law.

§ 3.28.080. Powers and duties.¶

The cultural arts commission shall have the following powers and duties:

(a) To support, encourage and facilitate the arts in the city;
(b) To encourage public access to the arts, by integrating art into all community activities;
(c) To identify and coordinate the needs and resources of artists and the community;
(d) To support art by and for young people;
(e) To write a policy statement;
(f) To raise funds to support the arts;
(g) To serve as liaison with artists and art commissions of other communities;
(h) To make recommendations to the council regarding indoor works of art offered to, commissioned by or purchased by the city and proposed to be placed, erected or created within city-owned buildings; (Direct offerings and bequests to city departments are excepted; works of art commissioned by the museum, library or recreation department are also excepted.)
(i) Jointly with the beautification committee to make recommendations to the council regarding works of art offered to, commissioned by or purchased by the city and proposed to be placed, erected or created outdoors on city property. § 3.28.085. Required votes for actions.¶

An affirmative vote of a majority of the total members of the cultural arts commission shall be required for any action by the commission.
