Chapter 5.80 — VENDING MACHINES — Orange Municipal Code

§ 5.80.010. Definitions.¶

For the purpose of this chapter, the following terms shall have the meanings here given to them:

"Vending machine" means a machine, appliance, or other mechanical device operated by currency, token, debit card, credit card, or any other form of payment that is designed or used for the sale of goods or merchandise, or service. As defined, this term does not mean vending machines dispensing food or beverages, which are regulated by Chapter 5.46.

"Vending machine business" means and includes the operation of one or more vending machines.

§ 5.80.020. Permit—Required.¶

No person shall conduct, manage, or carry on a vending machine business within the City without obtaining a proper permit therefor, as provided in this chapter. (Prior code 6560.1; Ord. 250; Ord. 290; Ord. 32-78)

§ 5.80.030. Permit—Application.¶

Application for a permit to operate a vending machine business shall be made to the Business Services Coordinator on forms provided by the Business Services Coordinator, which application shall contain the information in Section 5.32.010 and the following information:

A. The name and address of the owner, lessee, or other person in control of the establishment or establishments wherein the vending machine or machines are proposed to be located;
B. A complete description of the vending machines and the manner in which they are to be placed and operated;
C. A statement of the applicant's interest in, or title to, the vending machine or machines for which a permit is sought.

§ 5.80.040. Police Investigation of Applicant.¶

The Chief of Police shall cause each applicant to be fingerprinted and photographed, a record of which shall be kept in the office of the Chief of Police. The applicant shall pay the amount set by the State for processing the fingerprints. The Chief of Police shall cause an investigation of each applicant to be made to determine if such applicant has committed any act that if done by a permittee would be grounds for revocation or suspension of a permit, or if such applicant has been convicted of a felony or any crime that has a substantial relationship to the permitted business.

§ 5.80.050. Posting Business Permit.¶

In addition to compliance with Section 5.32.010, the permittee shall affix to each vending machine their name, address, and telephone number in such manner and form as the Business

Services Coordinator prescribes, and furnish to the Business Services Coordinator an accurate list of locations of all such vending machines each year at the time of renewal. (Prior code 6560.4; Ord. 32-78)

§ 5.80.060. Transfer of Permit.¶

No business permit issued pursuant to this chapter shall be transferable from one person to another person. A transfer may be made of a permit from one vending machine to another of the same character and mode of operation, during the period for which the same has been permitted in the first instance where the ownership and place of business remain the same, upon written application for such transfer by the permittee thereof to the Business Services Coordinator on a blank form, to be obtained from the Business Services Coordinator and the approval of such application by the Chief of Police.

§ 5.80.070. Permit Fee.¶

The permit fee for each applicant shall be such amount as is established from time to time by resolution of the City Council.
