Chapter 5.72 — SPECIAL PAGEANTS

§ 5.72.010. Definitions.

For the purpose of the provisions regulating special pageants hereinafter set forth, the following phrase shall be construed to have the meaning herein set forth unless it is apparent from the context that a different meaning is intended:

"Special pageant" means any event of limited duration conducted on property owned or controlled by the City. Such a pageant may include rides, games, booths, or similar amusement devices approved in accordance with the provisions set forth in this chapter. The regulations relating to a special pageant shall be applicable whether or not a business certificate is required and whether or not fee or admission is charged for such pageant. Nothing contained in this chapter shall be construed to include within the definition of a "special pageant" any "pancake breakfast," "bake sale," or similar event sponsored by a nonprofit organization where only food or beverages are served; provided that the City Manager shall have discretion to require the posting of a cash deposit to insure cleaning of the area in which food or beverages only are served.

§ 5.72.020. Permit—Required.

  • A. In order to receive a permit to conduct a special pageant on City-owned property within the City, it is necessary that the applicant prove that it is a nonprofit entity organized for fraternal, charitable, religious, or other nonprofit purposes, which organization has been in existence for at least six months prior to making application for a permit to conduct a special pageant and which organization has a regular membership and meets at regular intervals of at least once per month for purposes other than the conduct of special pageants.

  • B. Nothing contained in this chapter shall be construed to extend privileges to conduct a special pageant on City-owned sidewalks; provided, however, that private businesses, commercial establishments, and other profit-seeking enterprises may receive a permit from the City to conduct sidewalk sales subject to rules and regulations established by the City Council and administered by the City Manager. The City may grant such a sidewalk sale permit in accordance with such rules and regulations notwithstanding the provisions of Section 5.54.010 of the Orange Municipal Code.

§ 5.72.030. Permit—Application.

Application for permits to conduct special pageants shall be in writing and shall be filed with the City Manager not less than 14 days prior to the opening date of such pageant. In addition to the information in Section 5.32.010, an application shall contain the following information:

  • A. The name and address of the sponsoring business or organization;

  • B. The exact location where the event is to be staged;

  • C. The name and address of any operator or operators of rides, games, or amusement devices to be conducted on the City-owned property;

  • D. A list of communities in California where the operators of such rides, games, and amusement devices have previously conducted such operations;

  • E. The number and types of rides, games, shows, displays, and other individual concessions comprising the event, including any and all food stands and food vehicles to be used;

  • F. The number of persons who will be engaged in conducting the event;

  • G. A statement that the applicant nonprofit organization will operate and manage the special pageant and a copy of any agreements designed to ensure such control;

  • H. A plot plan showing the entire property in addition to that portion of the property proposed to be used to store equipment and to conduct the special pageant, including an exact description and plot plan describing the total extent of any off-street parking area which would be occupied for the purpose of conducting the special pageant and storing the equipment incident thereto;

  • I. Such other information as shall be required by the City Manager. (Prior code 6520.2; Ord. 32-78; Ord. 07-24, 5/14/2024)

§ 5.72.040. Investigation of Application.

Before issuing a permit for a special pageant, the City Manager shall cause an investigation to be made regarding the application and shall have the findings set forth in writing and attached to the application.

§ 5.72.050. Issuance or Denial of Permit.

If the City Manager determines, after the investigation, that all applicable provisions of the law and of the Orange Municipal Code, including all relevant provisions of Section 5.72.030 et seq. are, or will be, complied with, he or she shall issue a permit; otherwise, the application shall be denied.

§ 5.72.060. Conduct of Operations.

The following regulations shall govern the operation of any special pageant for which a permit has been issued by the City Manager, and violation of any such regulation shall be grounds for immediate revocation of such permit:

  • A. No wild or ferocious animals shall be displayed.

  • B. All local and state laws and regulations shall be observed.

  • C. Before erecting any structures, application must be made to the Chief Building Inspector. All applicable building and electrical regulations must be observed. Permits issued by the Cal/OSHA, Division of Occupational Safety and Health, must be furnished to the Chief Building Inspector before the operation of any ride. No rides, amusement devices or concessions shall be put into operation until inspected and approved by the Chief Building Inspector; provided, however, that no such inspection or approval by the City shall be construed as a representation by the City, or any employee thereof, that any such ride, amusement device, or concession is structurally or operationally safe. Each ride shall have

a sign, displayed at the entrance to the ride and visible to all patrons, containing the message that any person using the equipment does so at his or her own risk.

  • D. No game shall be permitted to be conducted at a special pageant until inspected and approved by the Police Chief. No game shall be approved which violates any laws of the state or any other provisions of the Orange Municipal Code. No game shall be approved in which it is impossible, due to the game equipment, for the participant to win by the use of skill.

  • E. Any and all facilities for the dispensing of food and beverages shall be inspected by the Orange County Health Department to insure compliance with all applicable food handling regulations.

  • F. No trailers, tents or other temporary living quarters will be allowed on the premises where the special pageant is to be conducted except upon approval of the City Council based on a finding that no hazard to public health or safety will result from such approval.

  • G. The conduct of the special pageant shall be confined to the hours of 9:00 a.m. to 10:00 p.m. unless the City Manager has established different hours of operation.

  • H. The special pageant shall not be operated for any period longer than seven days from the permitted opening date as specified in the permit.

  • I. All persons or entities granted a permit shall be required to post a cash deposit not to exceed $1,000.00 to ensure that the premises used for the pageant shall be left in a clean and orderly condition at the conclusion of the pageant.

§ 5.72.075. Prohibited Acts.

  • A. It shall be unlawful, within the limits of any special pageant for any person to do any of the following:

    1. To allow any animal (except for a service animal used by an individual with a disability) or fowl of any kind to be at the special pageant; provided, however, the City Council may grant permission to any such person to conduct animal shows, rides or carnivals having animals, under such conditions as the Council may determine; such conditions shall be for the purpose of protecting the special pageant against damage, and to assure cleanliness, to protect the City against liability for injuries to persons and damages to property, and for the preservation of the public health and safety;

    2. Ride or drive any horse or other animal; or propel any vehicle or automobile except in designated areas; or ride, drive, propel, or self-propel a skateboard, scooter (except for an individual with a disability), wagon, bicycle, tricycle or similarly wheeled device;

    3. Carry any knives, firearms, fireworks, airgun or slingshot;

  1. Cut, break, injure, deface, or disturb any tree, shrub, plant, rock, building, cage, pen, monument, fence, bench, or other structure, apparatus or property; or pluck, pull up, cut, take or remove any shrub, bush, plant, or flower; or mark or write upon, paint, or deface in any manner any building, monument, fence, bench or other structure;

  2. Wash dishes or empty salt water or other waste liquids elsewhere than in the sinks provided for such purposes;

  3. Leave garbage, cans, bottles, papers or other refuse elsewhere than in receptacles provided therefor;

  4. Indulge in riotous, boisterous, threatening, or indecent conduct;

  5. Distribute any handbills or circular, or post, place or erect any bills, notice, paper, or advertising device or matter of any kind, except at booths authorized by the City;

  6. Sell or offer for sale any merchandise, article or thing whatsoever except at booths authorized by the City;

  7. Practice, carry on, conduct or solicit for any trade, occupation, business or profession or circulate any petition of whatsoever kind or character without permission of the Council, except at booths authorized by the City;

  8. Remain, stay or loiter in any special pageant between the hours of 11:00 p.m. and 7:00 a.m. unless authorized by the City;

  9. Participate in, aid, or organize any assembly, exhibition, festival, musical program, parade, rally, show, or make any speeches, unless a permit has been obtained from the City Council or City Manager and unless such permit is in the possession of the person in charge of such activity;

  10. Parking, leaving or standing, or causing to be parked or causing to be left standing any vehicle whatsoever any place in the special pageant designated and marked by the Chief of Police as places where parking is prohibited.

§ 5.72.080. Powers of City Council.

  • A. The City Council shall have the power to review any action taken by the City Manager in denying any application for a permit and shall have the power to revoke a permit granted by the City Manager when, in the opinion of the City Council, such action on their part is in the public interest.

  • B. When the City Council has acted upon any application for a special pageant, all of the regulations set forth in this chapter shall apply to such special pageant.

  • C. The City Council shall also have the exclusive power to grant a renewal or extension of a permit beyond the original seven-day period.

  • D. The City Council may authorize the sale and permit the purchase, possession and consumption of alcoholic beverages at a special pageant in a manner provided in Section 5.72.085. "Alcoholic beverages" used in this section and in Section 5.72.085 shall be as defined by the Alcoholic Beverage Control Act of this State.

  • E. The Mayor may authorize the delivery, possession and consumption of wine at any event held in that portion of the City Hall designated as the George N. Weimer Conference and Reception Area, subject to conditions imposed by her or him. No other type of alcoholic beverage shall be served nor shall the sale or purchase of wine be authorized by the Mayor.

  • F. The City Council may authorize the sale and permit the purchase, possession or consumption of alcoholic beverages at any event to be held on the premises of the Ainsworth Historical House, 414 East Chapman Avenue. Such sale, purchase, possession, or consumption of alcoholic beverages must satisfy the requirements of the Alcoholic Beverage Control Act and any conditions which the Council may impose.

§ 5.72.085. Beverage Containers.

  • A. No vendor shall sell, deliver, give, or otherwise furnish to any person at a special pageant any alcoholic or nonalcoholic beverage in a container made all or in part of metal, glass or similar substances capable of being thrown or propelled with sufficient force as to cause injury if striking the person or property of another.

  • B. No person shall consume, deliver, buy, receive or otherwise possess at a special pageant any alcoholic or nonalcoholic beverage in a container made all or in part of metal, glass or similar substances capable of being thrown or propelled with sufficient force as to cause injury if striking the person or property of another.

§ 5.72.090. Violation—Penalty.

Any violation of any provision of these regulations governing special pageants shall constitute a misdemeanor and shall be punishable as provided in Section 5.30.050 of the Orange Municipal Code.

§ 5.72.100. Permit Fee.

Each application shall be accompanied by a permit fee in such amount as is established from time to time by resolution of the City Council.
