Chapter 10.02 — DEFINITIONS

For the purpose of this chapter, unless it is plainly evident from the context that a different meaning is intended, certain terms used herein shall have the definitions ascribed to them in this chapter.

For the purpose of this chapter, an abandoned vehicle is a vehicle to which possession has been relinquished and to which vehicle the person or persons relinquishing possession also intends to relinquish all right and title in said vehicle to the world. In determining whether a vehicle has been abandoned, the provisions of Section 22523 of the California Vehicle Code shall apply. (Prior code 10.04.010; Ord. 19-82)

The term "bicycle license receipt" shall mean and include the ownership card issued by the Police Department upon receipt of the designated license fee. (Prior code 10.68.010; Ord. 12-75; Ord. 19-82)

"Bicycle parking zone" means that space reserved exclusively for the parking of bicycles.

"Bicycle trail," "bicycle lane," or "bikeway" means all facilities that provide primarily for bicycle travel or as defined in Streets and Highways Code Section 890.4. (Ord. 4-00)

"Bus stop zone" means the area designated by signs or curb markings to be used for the loading and unloading of bus passengers. (Ord. 19-82)

"Business district" means that portion of the highway or street and the adjoining property upon which 50% or more of the contiguous frontage property is occupied by buildings for business for a distance of 600 feet, or upon both sides of the highway or street for a distance of 300 feet or as defined in Vehicle Code Sections 235 and 240.

As used in this chapter, "Chief of Police" means the Chief of Police of the City of Orange or deputies or authorized representatives.

"Council" means the City Council of the City of Orange.

"Curb" means the lateral boundary of the roadway whether such curb be marked by curbing construction, or not so marked; the word "curb" as herein used shall not include the line dividing the roadway of a street from parking strips in the center of a street, nor from tracks or rights of way of public utility companies.

For the purpose of this chapter, a dismantled vehicle is a vehicle from which the essential parts, as defined by the Vehicle Code, have been removed and which presents an outward appearance of having essential parts removed.

"Divisional island" means a raised or painted island located in the roadway and separating opposing or conflicting streams of traffic. (Ord. 19-82)

As used in this chapter, "highway" means a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. Highway includes street. (Prior code 10.60.020; Ord. 33-69)

For the purpose of this chapter, an inoperative vehicle is a vehicle which is incapable, for mechanical or other reasons, of operating under its own power and moving over streets or other areas, or is incapable of operating and being moved by the power of another vehicle over streets or other areas.

The term "licensing agency" or "agent" shall mean and include that party or parties designated by the City Council as the official licensing agency or agent for bicycles in this City. For purposes of this chapter, the Chief of Police and representatives shall be deemed as the licensing agency. The Chief of Police shall be given the authority to recommend for appointment by the City Council any person or persons to assist this City in the capacity of bicycle licensing agent. "Loading zone" means the space adjacent to a curb reserved through distinctive curb markings or

signs for the exclusive use of vehicles during the loading or unloading of passengers or materials. (Prior code 10.09.020(C))

"Non-motorized vehicle" means every detachable trailer or any other detachable device which itself is not self-propelled and is designed to be drawn by a motor vehicle. (Ord. 19-82)

Whenever certain hours are named herein, they shall mean standard time or daylight saving time as may be in current use in this City.

"Parkway" means that portion of a street or highway other than the roadway or the sidewalk or traffic islands.

"Passenger loading zone" means the space adjacent to a curb reserved through distinctive curb markings or signs for the exclusive use of vehicles during the loading or unloading of passengers. (Prior code 10.08.020(B))

"Police officer" means every sworn member of the Police Department, Police Reserves or any employee of the City of Orange authorized by the Chief of Police to direct or regulate traffic or to make arrests for violations of traffic regulations, or to issue citations. (Ord. 19-82)

As used in this chapter, the term "public property" does include "highway."

"School days" means all weekdays of the year excluding federal, state, local and school holidays. (Ord. 19-82; Ord. 19-99)

"Traffic lane" means that portion of any roadway, either marked or unmarked, being not less than nine feet in width, and used for vehicular traffic.

In addition to the definitions set forth above, all definitions of words and phrases set forth in the Vehicle Code of the State of California, are hereby incorporated in this chapter as though set

For the purpose of this chapter, a wrecked vehicle is a vehicle which has an outward manifestation or appearance of damage to the essential parts of said vehicle. (Prior code 10.60.020(H); Ord. 33-69; Ord. 19-82)
