§ 5.66.010. Certificate of Identification Required.

In addition to the other requirements of this code and ordinances of the City, and regardless of whether or not any person may be exempt from the payment of a business tax fee under any of the provisions of this code, every person engaged in the business of selling or soliciting orders for the sale of any goods, wares or merchandise, magazines, papers, periodicals, services or any other form of occupation or business involving canvassing and soliciting from house to house, or place to place, or upon the streets and public places within the City, shall, before engaging in such business or occupation, make application to the Business Services Coordinator of the City, and the Business Services Coordinator shall determine whether or not all necessary business license and permit fees have been paid by the applicant and if all necessary fees have been paid or tendered to the Business Services Coordinator of the City. § 5.66.020. Police Investigation of Applicant.

The Chief of Police shall cause each applicant to be fingerprinted and photographed, a record of which shall be kept in the office of the Chief of Police. The applicant shall pay the amount set by the State for processing the fingerprints. The Chief of Police shall cause an investigation of each applicant to be made to determine if such applicant has committed any act that if done by a permittee would be grounds for revocation or suspension of a permit, or if such applicant has been convicted of a felony or any crime that has a substantial relationship to the permitted business.

§ 5.66.030. Standards for Granting Certificate.

No certificate shall be issued to any applicant whose record reveals a conviction of any felony, any violation of Section 17500 of the Business and Professions Code or any related provision of the Business and Professions Code, any crime involving moral turpitude, or any violation of this chapter. Any conviction of the aforementioned offenses shall be cause for revocation of any certificate of identification issued herein.

§ 5.66.040. Display of Certificate.

  • A. Any person to whom such certificate is issued shall thereafter retain such certificate and maintain such certificate upon his or her person at all times while engaged in any of the activities mentioned in this chapter, and it shall be the duty of such person to display the same to any party of whom he or she solicits any business upon being requested to so display such certificate. Such person shall also display the certificate to any peace officer who requests that such certificate be displayed.

  • B. The provisions of this section shall be equally applicable to any person who aids and abets, controls or directs, or in any manner supervises the activities of any other person or persons to whom a certificate is required to be issued pursuant to this chapter.

§ 5.66.050. Disabled Veterans—Regulations.

Every honorably discharged soldier, sailor, marine, or airman of the United States, who is physically unable to obtain his or her livelihood by means of manual labor and who is a qualified voter of the State, shall have the right to hawk, peddle and vend any goods, wares or merchandise owned by him or her, except spirituous, malt, vinous or other intoxicating beverages, without the payment of a business tax or a permit; subject, however, to the restrictions, limitations, regulations and conditions set forth in Sections 5.66.060 through 5.66.090. § 5.66.060. Disabled Veterans—Compliance with Provisions.

Every applicant must comply with the following requirements before a permit may be issued under the provisions of this section:

  • A. Every applicant must furnish a Certificate of Physical Disability executed by a qualified surgeon of the United States Army, Navy, Marines, or Air Force, a certificate of Honorable Discharge from the United States Army, Navy, Marines, or Air Force, and a written recommendation from the representatives of the local posts of the American Legion and the Veterans of Foreign Wars.

  • B. Every applicant must furnish two identification photographs, one to be attached to the permit issued to the applicant, and the other to be attached to the copy retained by the Business Services Coordinator.

§ 5.66.070. Disabled Veterans—Conditions of Permit.

A permit, when issued, is subject to the following conditions:

  • A. It is nontransferable and for the exclusive use of the permittee named.

  • B. The applicant's identification photograph must be attached to the permit at all times, and failure to comply herewith is grounds for revocation of the permit and for refusing its renewal or the issuance of a new permit thereafter.

  • C. Should a permit be found in the possession of one other than the permittee named, it shall be surrendered to the Business Services Coordinator, and canceled, and neither the permittee named nor the holder thereof shall thereafter be entitled to hold a permit under the provisions of this section.

  • D. The permittee named must identify his or her self by exhibiting the permit whenever required to do so by the police officer, permit inspector or Business Services Coordinator of the City.

  • E. Whenever the permittee uses any wagon, cart, tray, basket or other vehicle or receptacle in vending any such goods, wares or merchandise, the permit shall be carried in a permit holder attached to the vehicle or receptacle and in plain view.

  • F. Every permit issued under the provisions of Sections 5.66.050 through 5.66.090 shall expire 30 days from and after the date of issuance and a new permit may thereafter be issued pursuant to the provisions of Sections 5.66.050 through 5.66.090.

§ 5.66.080. Disabled Veterans—Unlawful Possession of Permit.

It is unlawful for any person, other than the permittee named, to use or have in his or her possession any permit issued pursuant to the provisions of Sections 5.66.050 through 5.66.090. (Prior code 6490.4(c); Ord. 11-58; Ord. 32-78)

§ 5.66.090. Disabled Veterans—Purchase or Transfer of Permit Unlawful.

It is unlawful for any person to purchase or transfer any permit issued pursuant to the provisions of Section 5.66.050 through 5.66.090, or for any person to transfer or convey the certificates mentioned in Section 5.66.060(A) to any other person for the purpose of securing a permit as herein provided.

§ 5.66.100. Permit Fee.

Each application shall be accompanied by a permit fee in such amount as is established from time to time by resolution of the City Council.
