Chapter 9.04 — OFFENSES AGAINST PUBLIC PEACE AND DECENCY

9.04.010 - Flag poles—Misuse prohibited.

It is unlawful for any person to raise or display any flag, banner, standard, device, emblem, or other article except the flag of the United States of America or the official bear flag of the state of California upon or from any flag pole or staff designed and intended for the display of the flag of the United States of America or the official bear flag of the state of California and located upon any public grounds or within any public buildings belonging to or in the possession of the United States of America, the state of California, the county of Fresno, the city of Orange Cove or any public district or agency.

9.04.020 - Flag poles—Misuse prohibited—Exception.

The prohibition of Section 9.04.010 shall not apply to those ceremonial occasions when the flag or other colors of a friendly foreign power, the United Nations, any other state of the United States or the official flag or colors of any military organization of the United States or the state of California, are displayed with the authorization of the public agency owning or in the possession of the flag pole or staff involved and in strict accordance with the laws or regulations of this state, the United States of America or any department or agency thereof relating thereto.

9.04.030 - Drinking in and within view of streets and public rights-of-way.

No person shall drink any beer, wine or any other intoxicating beverage on any street, alley, sidewalk or sidewalk areas and highway of the city or within fifty feet and within public view of any street, alley, sidewalk or sidewalk area and highway of the city. This section shall not be deemed to make punishable any act or acts which are prohibited by any law of the state.

9.04.035 - Drinking in public parks.

No person shall drink any beer, wine, or any other intoxicating beverages in any city park, or at any city playground or indoor, outdoor recreational or sporting facility, or on any other city owned property. This

section shall not be deemed to make punishable an act or acts which are prohibited by the law of the state.

9.04.040 - Penalty.

Any person who violates section 9.04.030 and/or section 9.04.035 is guilty of an infraction.
