Chapter 12.04 — PARADES

For the purposes of this chapter, the following term is defined: "parade" means any march or procession consisting of persons, animals or vehicles, or combination thereof, except funeral procession, upon any public street, sidewalk, alley or other public place, which does not comply with normal and usual traffic regulations or controls.

No person shall conduct, manage or participate in any parade without a written permit from the city. "Person" shall include corporation or association.

Parade permit application forms shall be obtained from the city clerk. Applications shall be filed with the city clerk at least ten days prior to the proposed parade date. The application shall contain the name and address of the person or organization sponsoring the parade. Any required filing fee shall be submitted with the application.

A.

The committee consists of police chief, fire chief, and public works superintendent.

B.

The committee shall:

Review the application;

Meet with applicant;

Request applicant for additional information and materials;

Make a written report and recommendation within twenty-one days after application was filed or as soon after the twenty-one days as requested additional information and materials are supplied; and

Give the applicant and file with the commission its written report and recommendations within seven days of the making thereof.

A.

A copy of the staff recommendations shall be submitted to the park and recreation commission in writing and a copy to the applicant at least four days prior to the park and recreation commission's consideration.

B.

The application shall not be submitted to the parks and recreation commission until the application and additional information as requested by the review committee are complied with.

The commission shall recommend approval, conditional approval, or disapproval of the application at its meeting next following the committee's report and recommendation being given and filed pursuant to

The commission shall make a written report and recommendation, give copy to applicant, and file copy with council within seven days according to Section 12.04.050(A).

C.

The commission's recommendation of disapproval is final unless the applicant files a written appeal with the council within seven days of provisions of Section 12.04.050(B).

If the parks and recreation commission disapproves the application for use permit, it shall mail to the applicant within five days after the date, a notice of its action stating the reasons for denial of the application. Any person aggrieved shall have the right to appeal the denial of an application to the council by filing a written notice thereof with the city clerk within five days of the notice of such action. The decision of the council after a hearing on such appeal shall be final.

The city council, at its next regular meeting following the receipt of the parks and recreation commission's recommendation, shall approve, conditionally approve, or disapprove the application. The applicant shall be notified of the council's action within one week following such action. The council's action is final.

If the applicant fails to comply with the conditions set by the city council, the permit shall be revoked.
