Sec. 2-5-62. - Scope.

This Article 3 of Division 5 shall apply in all parks and park waters falling within the definition of those terms as set forth in section 2-5-2 of said division.

Sec. 2-5-63. - Fishing.

(a) Designated Waters. No person shall fish or practice casting, including but not limited to fly casting, in any park, beach or recreational area except in areas designated and under conditions established by the Director.

(b) Method of Take. No person shall fish in any park waters in any manner other than by one (1) rod and line or one (1) handline, with the rod or line closely attended, except in areas designated and under conditions established by the Director. No person shall use a line with more than one (1) hook or with one (1) artificial lure with no more than three (3) hooks integral to the lure. No person shall fish by the use of drugs, poison, explosives, or electricity in park waters except persons in the performance of their official duties. No person shall fish by use of net, spear or weapon in park waters except in areas designated and under conditions established by the Director and in accordance with State law.

(c) Bait Restrictions. No person shall use live or dead minnows or other bait fish, amphibians, arthropods, or nonpreserved fish eggs or fish roe, except in park waters designated by the Director. No person shall dig for or otherwise gather bait within a park, beach, or recreational facility except in areas designated and under conditions established by the Director.

(d) Inspection. Any peace officer may check fishing licenses and inspect creels, tackle, and fishing gear for compliance with the provisions of this section.

Sec. 2-5-64. - Swimming.

No person shall swim, bathe, wade or otherwise enter in or into any park waters other than those park waters designated by the Director for such swimming, bathing, wading or entering.

Sec. 2-5-65. - Fire regulation.

(a) Campfire Location and Permit. No person shall build, light or maintain any fire in any park, beach or recreational area except in a camp stove, fire ring, barbecue or fireplace provided in areas designated by the Director for such purposes; provided, however, that camper, trailer, oil or gas camp stoves and braziers or hibachis may be used in areas designated for their use by the Director; and further provided that in wilderness areas sites may be designated by the Director wherein persons who have obtained campfire permits from the Director may build small campfires. The authority of the Director to permit campfires within parks, beaches or recreational areas is limited to those areas not restricted by State and local fire prevention officials.

(b) Removal of Combustible Materials. No person shall build a campfire in any park, beach or recreational area until he has first cleared an area of twenty-five (25) feet in all directions from said campfire site of all deadwood, moss, dry leaves or other combustible material.

(c) Extinguishing Fires. Each person building or using a campfire, fire ring, barbecue, fire place in any park, beach or recreational area shall, when said campfire, fire ring, barbecue, fire place is no longer needed, extinguish said campfire, fire ring, barbecue, fire place by thoroughly wetting and stirring the combustible material and covering it with sand or dirt.

(d) Fire Prevention. Every person shall make the suppression and prevention of fire their first consideration while using any park, beach or recreational area. Any negligent use of combustible materials is prohibited. Any person learning of an unauthorized fire in any park, beach or recreational area shall extinguish it if he can do so without endangering himself, or, if he cannot extinguish it, shall promptly communicate the position of the fire to park officials.

(e) Smoking. The Director may restrict or prohibit smoking in all or any part of a park, beach or recreational area when fire danger requires such action. In such cases the Director shall post smoking regulations at conspicuous locations. No person shall smoke in any park, beach or recreational area in violation of such regulations.

Sec. 2-5-66. - Boating regulation.

(a) Boating. No person shall operate any boat or similar device in, on, or through any park waters except in areas designated and under conditions established by the Director.

(b) Launching. No person shall launch or cause to be launched any boat or similar device in any park, beach or recreational area except in areas designated and under conditions established by the Director.
