Sec. 1-4-225. - Grant or conveyance of easements, licenses or permits not exceeding…

(a) Pursuant to Government Code Section 25526.6, the Board of Supervisors hereby authorizes the Chief Real Estate Officer, or designee, to grant or otherwise convey easements, licenses, or permits not exceeding fifty thousand dollars ($50,000.00) in value, and to approve and execute the following types of collateral instruments: license agreement and supporting documents; permit and supporting documents; easement deeds, agreements, grant of easement and supporting documents, and; escrow instructions for conveyance of easements or other property interests, when the following four (4) criteria are met:

(1) The value of the easement, license, or permit does not exceed fifty thousand dollars ($50,000.00) for each easement as determined by the Chief Real Estate Officer, or designee.

(2) The easement, license, or permit is to be granted or otherwise conveyed to the State, or to any county, city, district, or public agency or corporation, or to any public utility corporation.

(3) The conveyance of the easement, license, or permit is in the public interest, and such conveyance will not substantially conflict or interfere with the use of the property by the County.

(4) The easement, license, or permit documents have been approved by County Counsel and the operating agency/department.

(b) The Board of Supervisors hereby directs the Chief Real Estate Officer, or designee, to apply the following three (3) limiting criteria:

(1) The value of easements, licenses, or permits granted under this authority to any one (1) entity within one (1) fiscal year shall not exceed two hundred thousand dollars ($200,000.00).

(2) The number of easements, licenses, or permits granted under this authority to any one (1) entity shall not exceed ten (10) per fiscal year, with the exception that easements, licenses, or permits required by public agencies and utility companies, to provide utility service to County buildings and facilities, shall not be counted toward this limitation of ten (10) per fiscal year.

(3) The value of all easements, licenses, or permits granted under this authority shall be limited to a cumulative value not to exceed four hundred thousand dollars ($400,000.00) per fiscal year.

(c) The Board of Supervisors hereby directs the Chief Real Estate Officer, or designee, to submit an annual report to the Board of the easements, licenses, or permits granted under this authority, excluding collateral instruments, which do not exceed fifty thousand dollars ($50,000.00).
