Sec. 1-4-220. - Acquisition not exceeding $300,000.

(a) Pursuant to Government Code Section 25350.60, the Board of Supervisors hereby authorizes the Chief Real Estate Officer, or designee, to approve and accept on behalf of the County acquisitions of any interest in real property, including indemnification when necessary, when the following criteria are met:

(1) The negotiated price of the property interest does not exceed three hundred thousand dollars ($300,000.00) for each interest acquired by the County (or, notwithstanding any County policy or resolution to the contrary, when no price is negotiated, such as in a dedication or gift, where the value of the dedication or gift does not exceed, three hundred thousand dollars ($300,000.00) as determined by the Chief Real Estate Officer, or designee.

(2) The acquisition of the property interest has been approved by the Chief Real Estate Officer, or designee and the acquiring agency/department; and the acquisition documents have been approved by County Counsel.

(3) The property interest is to be acquired in accordance with the County of Orange Hazardous Materials Assessments Policy and Procedure, subject to approval of any insurance or hazardous material assessments by CEO/Risk Management when those terms diverge from commonly acceptable County standards.

(b) The Board of Supervisors hereby directs the Chief Real Estate Officer, or designee, to submit an annual report to the Board of the property interests acquired under this authority, except for any gift valued in excess of ten thousand dollars ($10,000.00) which shall be reported quarterly.

(c) Notice of intention to consummate said acquisition shall be provided pursuant to applicable law.

(d) The authority granted by this Ordinance shall terminate on May 5, 2030.

Sec. 1-4-221. - Acquisition of real property by eminent domain for the santa ana…

(a) Pursuant to Health and Safety Code Section 33342.7, a legislative body that adopted a final redevelopment plan before January 1, 2007, shall adopt an ordinance that describes the local agency's policy for acquiring or not acquiring real property by eminent domain in specified locations within the redevelopment area.

(b) Pursuant to the requirements of California Health and Safety Code Section 33342.7, the Orange County Development Agency shall not acquire real property in the Santa Ana Heights Project Area through eminent domain.

(c) The adoption of this section shall not be deemed to affect the ability of the Orange County Development Agency or any other agency of the County of Orange to complete the acquisition of real property through eminent domain proceedings that have been initiated prior to the date of adoption of this section.

(a) Pursuant to Health and Safety Code Section 33342.7, a legislative body that adopted a final redevelopment plan before January 1, 2007, shall adopt an ordinance that describes the local agency's policy for acquiring or not acquiring real property by eminent domain in specified locations within the redevelopment area.

(b) Pursuant to the requirements of California Health and Safety Code Section 33342.7, the Orange County Development Agency shall not acquire real property in the Neighborhood Development and Preservation Project Area through eminent domain.
