§ 4-19.101. Definitions.¶

For purposes of this chapter, "parade" shall mean any march or procession of persons, animals, or vehicles, or combination thereof, upon any public street, sidewalk, alley or other public place, which does not comply with normal traffic regulations or controls.

§ 4-19.102. Permit—Required.¶

No person shall conduct, manage, lead, or participate in any parade unless a permit therefor shall have been previously issued, as provided for in this chapter.

§ 4-19.103. Application.¶

Any person desiring to conduct or manage a parade shall, not less than 15 days prior to the date on which it is proposed to conduct such parade, file with the City Manager a written application for a parade permit setting forth the following information:

(a) The name, address, and telephone number of the person requesting the permit;
(b) The name and address of the person, group, organization, corporation or other entity sponsoring the activity, if any;
(c) The nature and purpose of the proposed parade;
(d) The date, time and place of the start of the parade, the time when parade participants will begin to assemble at the starting place, and the time and place the parade shall finish;
(e) The route the parade shall travel, described by street names and travel directions, including a description of the starting point and termination point;
(f) The estimated number of persons who will participate in the parade; where applicable, the number and type of animals and the proposed method of their control, and the number and kinds of vehicles and their proposed speed;
(g) Any other information regarding the public health, safety and welfare which the City Manager finds reasonably necessary to a fair determination as to whether a permit should be issued.

§ 4-19.104. Permit—Issuance conditions.¶

The City Manager shall act on an application for a parade within 10 days after said application is filed. The City Manager shall issue said permit unless the City Manager finds:

(a) The parade will substantially interfere with the safe and orderly movement of vehicular traffic along, crossing, or contiguous to its proposed route; or
(b) The proposed time or estimated size of the parade, the manner in which it is proposed to be conducted or its proposed route will require so great a diversion of police officers to secure the line of movement and areas contiguous thereto such that the remainder of the City will be left without adequate police protection; or
(c) The proposed parade route will substantially interfere with the ability of emergency vehicles or equipment to move from the locations where normally parked when not in use to the scene of an emergency; or
(d) The proposed time and route of the parade will substantially interfere with a previously scheduled and publicly announced activity involving or available to the general public; or
(e) The estimated concentration of persons, animals or vehicles or combinations thereof at the parade's assembly or termination points will substantially interfere with fire and police protection of or ambulance service to these points and contiguous areas in the event of an emergency; or
(f) The conduct of such parade will obstruct any construction or maintenance work scheduled to take place upon public roads.

§ 4-19.105. Alternative dates, times and routes.¶

If a proposed parade is found by the City Manager to conflict with any of the requirements of this chapter, the City Manager may suggest an alternate date, time, route and associated terms and conditions. If the applicant wishes to accept the proposed date, time, route and associated terms and conditions, the applicant may, within three days, file a notice of acceptance and the City Manager shall proceed to issue the permit upon said terms and conditions.

§ 4-19.106. Permit contents.¶

The permit shall contain:

(a) The starting time and route of the parade;
(b) The maximum length of such parade in miles or kilometers, or fractions thereof;
(c) The minimum and maximum permissible speeds of the parade;
(d) The maximum number of persons, animals and vehicles which will be allowed to participate in the parade, provided that said numbers shall not be less than the estimated numbers in the permit application without the prior written consent of the applicant.

§ 4-19.107. Permit—Rejection—Notice.¶

If the City Manager finds that a parade permit should not be issued, he or she shall notify the applicant by mail within 10 days after the date on which the application was originally filed with the City and state in general terms the reason for the denial of the permit.

§ 4-19.108. Appeals.¶

Interested persons shall have the right to appeal to the City Council from determinations made by the City Manager with respect to parade permits. Such appeals shall be controlled by the provisions of Chapter 4 of Title 1 of this Code.

§ 4-19.109. Revocation of permit.¶

Any permit for a parade may be revoked by the City Manager at any time because of a disaster, public calamity, or other emergency, because the permit was issued through mistake or inadvertence, or because the safety and convenience of the public or property requires such revocation, as determined by the City Manager.

§ 4-19.110. Interfering with activity prohibited.¶

No person shall:

(a) Knowingly join or participate in any parade conducted pursuant to a permit under this chapter in violation of the terms of such permit;
(b) Knowingly join or participate in any permitted parade without the consent and over the objection of the permittee;
(c) Interfere with the progress or orderly conduct of any such parade, including, but not limited to:
- (1) Physically blocking the progress of parade participants,
- (2) Running or walking across the parade route while it is in progress, or
- (3) Pushing or shoving parade participants; or
(d) Throw or project objects or materials at parade participants or spectators.
