Chapter 1.04 — GENERAL PROVISIONS

This Code shall be known as the "Norwalk Municipal Code" and it shall be sufficient to refer to the Code as the "Norwalk Municipal Code" in any prosecution for the violation of any provisions thereof or in any proceeding at law or equity. It shall also be sufficient to designate any ordinance adding to, amending, or repealing this Code, or portions thereof, as an addition or amendment to, or repeal of the "Norwalk Municipal Code," or a portion thereof. This Code shall consist of all the regulatory and penal ordinances and certain of the administrative ordinances of the City. (Prior code § 1-1.2; Ord. 21-1722 § 2)

Upon the adoption of any amendment or addition to this Code, or upon the repeal of any of its provisions, the City Clerk shall certify thereto. Duly certified copies of every ordinance making changes in this Code shall be filed in the office of the City Clerk in books for such purpose, duly indexed for ready reference.

Not less than three copies of this Code shall be filed for use and examination by the public in the office of the City Clerk. Additional loose-leaf copies of the Code shall be distributed as determined by the City Clerk, including the exchange thereof for codifications or compilations of laws of other public bodies or entities.

At least semi-annually, the City Clerk shall cause the loose-leaf pages of the Code in which changes have been made to be reprinted, including a notation as to the ordinance number pursuant to which such change is adopted.

Unless specific provisions or the context otherwise require, these general provisions, rules of construction and definitions shall govern the construction of this Code. The provisions of this Code and all proceedings under it are to be construed with a view to effect its objects and to promote justice.

As used in this Code:

"City" means the City of Norwalk.

"City Hall" means the development consisting of two administrative office buildings and a Council Chamber building (included subsurface building area) located at 12700 Norwalk Boulevard in the City of Norwalk.

"Council" or "City Council" means the City Council of Norwalk.

"County" means the County of Los Angeles.

"Goods" means and includes wares or merchandise.

"Oath" means and includes affirmation.

Office. The use of the title of any officer, employee, office or ordinance shall mean such officer, employee, office or ordinance of the City of Norwalk.

"Operate" means and includes carry on, keep, conduct or maintain.

"Owner" applied to a building or land means and includes any part owner, joint owner, tenant, tenant in common, joint tenant, of the whole or a part of such building or land.

"Person," as used in this Code or in any uniform code adopted by this Code, means and includes any person, firm, association, organization, partnership, business trust, company or corporation, and any municipal, political or governmental corporation, district, body or agency other than the City of Norwalk.

"Sale" means and includes any sale, exchange, barter or offer for sale.

"State" means the State of California.

"Street" means and includes all streets, highways, avenues, lanes, alleys, courts, places, squares, sidewalks, parkways, curbs or other public ways in this City which have been or may hereafter be dedicated and open to public use, or such other public property so designated in any law of this State.

"Tenant" or "occupant" applied to a building or land means and includes any person who occupies the whole or part of such building or land, whether alone or with others. (Prior code § 1-4.2; Ord. 21-1722 § 2)

As used in this Code:

Gender. The masculine gender includes the feminine and neuter.

"May" is permissive.

Number. The singular number includes the plural, and the plural includes the singular.

"Shall" is mandatory.

Tenses. The present tense includes the past and future tenses, and the future tense includes the present tense.

Title, chapter and section headings contained in this Code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section of this Code.

This Code shall refer only to the omission or commission of acts within the territorial limits of the City and to that territory outside of the City over which the City has jurisdiction or control by virtue of the Constitution, or any law, or by reason of ownership or control of property. Whenever in this Code any act or omission is made unlawful, it shall include causing, permitting, aiding, abetting, suffering or concealing such act or omission. (Prior code § 1-4.5; Ord. 21-1722 § 2)

Whenever a power is granted to or is duly imposed upon a public officer or employee, the power may be exercised or the duty may be performed by a deputy of such officer or employee, or by a person otherwise duly authorized pursuant to law or ordinance, or by an officer of the County of Los Angeles, or by a deputy or employee of such officer when by contract with the City of Norwalk such officer is obligated and has agreed to perform certain duties on behalf of the City, unless this Code expressly provides otherwise.
