§ 8.52.010. Applicability.

  • A. None of the requirements contained in this chapter shall be applicable and subject to enforcement until the City Council adopts a resolution imposing the requirements. The City Council shall adopt such a resolution only at a duly noticed public hearing and after making the following findings:

    1. That the Metropolitan Water District of Southern California has imposed water allocation restrictions; and

    2. That current drought conditions in Southern California require the imposition of the water conservation requirements.

  • B. None of the requirements contained in this chapter shall apply to the City's splash pad, spray pool, and wading pool facilities at its various parks.

§ 8.52.020. Hose watering prohibition.

  • A. The use of an automatic shutoff nozzle shall be required on water hoses.

  • B. No person shall use water or wash down any sidewalks, walkways, driveways, streets, parking areas or other paved surfaces, except as is required for the benefit of public health and safety. Use a broom, not water, to clean sidewalks and driveways. No person shall leave a water hose running while washing a vehicle or at any other time.

§ 8.52.030. Watering of lawns and landscaping, and construction site preparation.

  • A. No person shall water or cause to be watered any lawn or landscaping between the hours of 6:00 a.m. and 6:00 p.m.

  • B. No person shall water or cause to be watered any lawn or landscaping more often than every third day.

  • C. Commercial nurseries, golf courses and other water-dependent industries are prohibited from watering landscape more often than every other day and between the hours of 10:00 a.m. and 4:00 p.m.

  • D. The use of potable water is prohibited for the irrigation of non-functional turf not regularly used for human recreational purposes or for civic or community events at commercial, industrial, and institutional sites. At the discretion of the City, continued irrigation of nonfunctional turf may be approved if it can be demonstrated that the water use is allowable under current State water restrictions.

  • E. The use of potable water for the irrigation of non-functional turf is not prohibited to the extent necessary to ensure the health of trees and other perennial non-turf plantings or to the extent necessary to address an immediate health and safety need.

  • F. No person shall water or cause to be watered any lawn or landscaping to such an extent that

runoff into adjoining streets, parking lots or alleys occurs due to incorrectly directed or maintained sprinklers or excessive watering.

  • G. It shall be the duty of all persons to inspect all hoses, faucets and sprinkling systems for leaks, and to cause all leaks to be repaired as soon as is reasonably practicable.

  • H. No person shall water or cause to be watered any lawn or landscaping within 48 hours after measurable rainfall.

  • I. No person shall use potable water for irrigation of ornamental turf on public street medians.

  • J. Only use potable water for street cleaning or construction site preparation purposes, if no other method can be used.

§ 8.52.040. Indoor plumbing and fixtures.

It shall be the duty of all persons to inspect all accessible indoor plumbing and faucets for leaks and to cause all leaks to be repaired as soon as is reasonably practicable. (Ord. 09-1619 § 1; Ord. 12-1637 § 1; Ord. 21-1722 § 2)

§ 8.52.050. Public eating places.

No restaurant, hotel, cafeteria, café, or other public place where food is sold or served shall serve drinking water to any customer unless specifically requested to do so by such customer. (Ord. 09-1619 § 1; Ord. 12-1637 § 1; Ord. 21-1722 § 2)

§ 8.52.060. Decorative fountains.

No person shall use water to clean, fill, or maintain levels in decorative fountains, ponds, lakes, or other similar aesthetic structures unless such water flows through a recycling system. (Ord. 09-1619 § 1; Ord. 12-1637 § 1; Ord. 21-1722 § 2)

§ 8.52.070. Procedural requirements.

The City Manager shall periodically review the provisions of this chapter and recommend necessary updates to the City Council. The review of the provisions and preparation of resulting recommendations, if any shall be performed, at a minimum, every two years. (Ord. 09-1619 § 1; Ord. 12-1637 § 1; Ord. 21-1722 § 2)

§ 8.52.080. Violations.

Willful violation of this chapter shall be subject to a written warning for the first violation, and shall be an infraction punishable by a fine as described in Section 1.16 (Violations) of the Norwalk Municipal Code for each subsequent violation.
