Chapter 2.16 — PLANNING COMMISSION

A Planning Commission which may be known and referred to as the Planning Commission of the City of Norwalk, California is created and established. (Prior code § 2-4.1; Ord. 21-1722 § 2)

• A. Individual City Council members may designate a nominee for membership on the Commission. All appointments shall be approved by a majority of the City Council and shall hold office for a term coexistent with that of the City Councilmember making the appointment.

• B. If a vacancy shall occur otherwise than by expiration of term, it shall be filled by appointment for the unexpired portion of the term. Such appointment shall be governed by subsection A of this section.

Any member of the Commission may be removed by either of the following:

• A. The appointing official, subject to approval of the City Council;

• B. A majority vote of the City Council. (Prior code § 2-4.3; Ord. 21-1722 § 2)

• A. The Planning Commission shall have such of the powers and duties provided in Title 7 of the Governmental Code, as are specified by the City Council.

• B. The Commission shall, with the assistance of the planning staff and consultants of the City, prepare and approve a comprehensive, long term general plan for the physical development of the City and of land outside its boundaries which in the Commission's judgment bears relation to its planning. This plan shall be officially certified as the Master Plan upon its adoption by the Commission and the City Council.

The Master Plan, and precise plans relating thereto, may be prepared in the form and manner provided in the Planning Law of the State. (Prior code § 2-4.4; Ord. 21-1722 § 2)

The Commission shall hold at least one regular meeting in each month, and such additional meetings as are required to expedite its business. Three voting members of the Commission shall constitute a quorum for the transaction of the business. (Prior code § 2-4.5; Ord. 21-1722 § 2)

• A. Except as otherwise provided in this chapter or by law, the Commission shall have the power to and shall provide for its own organization; shall adopt rules and regulations for the transaction of business before it; and shall designate the time and place for the regular monthly meeting of meetings of the Commission.

• B. The Commission shall keep a public record of its resolutions, transactions, findings and determinations.

Regular participation in the meetings of the Planning Commission being essential to the performance of its duties, any regular member who shall fail to attend three consecutive regular meetings, or four out of any five consecutive meetings shall, unless otherwise determined by action of the City Council, be removed and replaced by the Mayor, with the approval of the City Council, or by a majority vote of the City Council. The term "regular meeting" includes any meeting provided for by law or rule of the Planning Commission, or any regularly advertised public hearing.

It shall be the duty of the Secretary of the Planning Commission to keep a public record of the attendance of Commission members; and to promptly advise the City Council in the event any vacancy shall exist, or in the event any member of the Commission shall be absent for three successive meetings, or for four out of any five consecutive meetings. The Planning Commission shall comply with such requests and directives as shall be directed to it by the City Council, and shall, so far as applicable, conform to and abide by all laws, ordinances, rules and regulations of the City. (Prior code § 2-4.8; Ord. 21-1722 § 2)

The City Council shall provide the funds, equipment and accommodations necessary for the work of the Planning Commission by annual appropriations and such additional appropriations supplementary thereto as are required. The expenditures of the Commission shall be in the amount appropriated for the respective purposes.

• A. The members of the Planning Commission shall receive monthly reimbursement of expenses in an amount established annually by the City Council. That reimbursement shall be made at the end of each calendar month without the necessity of presentation of an itemized accounting, receipts, vouchers or other documentation. Such regular, actual and necessary expenses do not include expenditures which may be incurred on such matters as set forth in subsection B of this section.

• B. The members of the Planning Commission and members of the staff of the Commission, shall inform themselves on matters affecting the functions and duties of the Commission. For that purpose, and when authorized by the Commission, such members may attend planning conferences, meetings of planning executives, or hearings on planning legislation,

or matters affecting all or part of the Master Plan. The reasonable traveling expenses incidental to such attendances shall be charges upon the funds allocated to the Commission. The Commission may when authorized by resolution of the City Council, pay dues for membership in organizations engaged in the study of planning.

The Design Review Board means the Planning Commission as set forth in Sections 2.16.010—2.16.090.
