ON-STREET DISABLED PARKING SPACES

The purpose of this chapter is to establish procedures for the processing of applications to install a blue curbed parking space for exclusive use of a disabled person in front of or adjacent to their residence.

"Disabled person's license plate" is a special identification license plate issued pursuant to California Vehicle Code Section 5007 that is current and valid.

"Disabled person's placard" is a distinguishing placard issued pursuant to California Vehicle Code Section 22511.55 or 22511.59 that is current and valid.

"On-street disabled access parking space," or "blue curb," means a disabled access parking space on a public street indicated by a sign as well as blue paint on the curb or edge of the paved portion of street adjacent to the space as described in California Vehicle Code Section 22511.7(b)(1) and (2) and is for the exclusive use of a vehicle that displays a disabled person's placard or disabled person's license plate.

• A. An eligible applicant as described in Section 10.10.060 may submit an application on a form furnished by the Department of Public Safety. The application at a minimum shall contain the following information:

  1. The name, address, telephone number of the applicant;

  2. A copy of the applicant's valid California driver's license or valid identification card;

  3. A copy of the registration for the applicant's permanent disabled person's placard or disabled person's license plate;

  4. A completed petition on a form furnished by the Department of Public Safety signed by all nine surrounding neighbors as follows: four properties on each side of applicant's residence, the property directly across the street, and the four properties on each side of the property directly across the street. If the applicant lives on a property which has less than the required number of neighbors, a resident from each adjacent property and properties across the street from the applicant must sign the petition; and

  5. Any supplemental information deemed necessary by the Director of Public Safety.

• B. No application will be accepted and processed unless all the information required by this chapter is provided.

• C. Upon receipt of the application and verification of the applicant's eligibility, City staff shall forward the application to the Public Safety Commission for consideration. In order to determine eligibility, the City shall conduct a site visit at the applicant's residence in order to verify the eligibility requirements set forth in Section 10.10.060 as well as to assess the

overall conditions of the applicant's residence and public street parking. (Ord. 16-1677 § 1; Ord. 21-1722 § 2; Ord. 22-1730 § 1)

• A. After determining eligibility, the application shall be submitted to the Public Safety Commission for consideration at a regular meeting of the Commission to either approve or deny the request. Notice of the time and date of the meeting shall be given by first class mail to the applicant and surrounding residents within 200 feet of the applicant's external property line.

• B. The applicant is required to attend the meeting at which the application will be considered. If the applicant is physically unable to attend, a representative must attend on his or her behalf. If the applicant or the applicant's representative fails to attend the meeting, the application may be denied in the Commission's discretion.

• C. The Public Safety Commission shall adopt a resolution either approving or denying the application for the on-street disabled access parking space in front of or adjacent to the applicant's residence if the Commission finds that such space is required for the applicant's accessibility and safety. If there are multiple vehicles associated with or registered to the residence, the Commission may take into consideration whether greatest consideration for on-site parking spaces is given to the applicant amongst such vehicles.

• D. The resolution of approval shall include conditions as recommended by the Department of Public Safety, including that the applicant agrees to execute a document accepting the conditions of approval. Once the signed acceptance of conditions form is received, a request shall be forwarded to the City Traffic Engineer to begin installation of the blue curb.

• E. Notice of the decision of the Public Safety Commission shall be mailed to the applicant by certified or registered mail at the address shown on the application no later than three calendar days following the Commission's decision. If the decision is to deny the application, the notice of decision shall include the reasons for denial.

• F. The decision of the Public Safety Commission shall become final and effective 20 days after delivery or mailing of the notice of decision unless prior to 5:00 p.m. of the 20th day, a written appeal has been filed with the City Clerk by the applicant or by a person specially aggrieved or the City Council elects to review the decision of the Public Safety Commission. The notice of appeal shall include the reason why the decision of the Public Safety Commission should be reversed. The City Council shall hold a hearing on the appeal within 60 days of the filing of the appeal. The decision of the City Council shall be final.

• G. Blue curbs approved by the Public Safety Commission shall be effective for one year and are subject to renewal as set forth in Section 10.10.080.

No resolution designating an on-street disabled access parking space shall be enforceable until signs and markings giving adequate notice have been placed. The City's Traffic Engineer is authorized to mark the curb with blue paint on the curb or edge of the paved portion of street adjacent to the space. In addition, the City's Traffic Engineer shall install a sign posted

immediately adjacent to and visible from the space. The sign shall consist of a profile view of a wheelchair with occupant in white on a blue background and shall clearly state the following: "Minimum Fine $250."

A person is eligible to apply for an on-street disabled access parking space in front of or adjacent to his or her residence if all of the following criteria are satisfied:

• A. The applicant must reside in and own the residential property for which he or she is applying for the blue curb, or, if he or she is a tenant of the property, shall furnish a letter of support from the property owner of the residence;

• B. The applicant must have a permanent disabled person's placard or disabled person's license plate issued to them. Applicants with temporary disabled placards are not eligible to apply;

• C. Affected residents (two properties on each side of applicant's residence, the property directly across the street, and the two properties on each side of the property directly across the street) must all sign a petition supplied by the Department of Public Safety. If the resident is a tenant, the owner must sign the petition or furnish a letter of support;

• D. The applicant/resident must have a minimum of 18 feet of available curb length in front of, or adjacent to his or her residence;

• E. The applicant's garage may not be used for storage and the property must be free from any code violations; and

• F. On-site parking spaces must be used for parking of operable vehicles, and may not be used for storage of inoperable/abandoned vehicles as described in Chapter 8.12.

• A. The application shall be accompanied by a nonrefundable processing fee in an amount established by resolution of the City Council.

• B. Appeal of Decision. An appeal application shall be accompanied by a nonrefundable fee in an amount established by resolution of the City Council.

• A. For the purposes of this chapter, a year shall be the time period between July 1 and June 30.

• B. At the beginning of each year, between July 1 and July 31, the City will send out renewal notifications by mail to each individual who has an approved blue curb in front of or adjacent to his or her property in order to verify whether the individual still resides at the property and there is a continued need for the on-street disabled access parking space.

  1. The individual shall fill out the renewal application with all requested information.

2. The individual shall provide copies of the following in order to verify the continued need of a blue curb in front of or adjacent to his or her residence:

   • a. Valid California driver's license or valid identification card of the individual on the original application;

   • b. Disabled person's placard registration, issued to the individual on the original application; or registration for disabled person's vehicle license plate issued to the individual on the original application.

3. The renewal application and required copies shall be submitted to the Department of Public Safety no later than 30 days after the date of the renewal notification letter. Postmarks within 30 days of the letter will be accepted.

4. If renewal application and copies of required paperwork are not submitted, the City will proceed with the removal of the disabled access parking space. Once removed, the disabled access parking space will not be reinstated for the original applicant and a new application is required to be filed.

• A. The City's Traffic Engineer is authorized to remove an on-street disabled access parking space when the Traffic Engineer finds as follows:

  1. The original applicant no longer resides at the address for which the blue curb was requested;

  2. The original applicant fails to submit required renewal paperwork as described in Section 10.10.080;

  3. The original applicant no longer has a need for the disabled access parking space and a written removal request is submitted by the applicant to the Department of Public Safety.

• B. Once a disabled access parking space is removed, it will not be reinstated for the original applicant and a new application is required to be filed.

The City Council may by resolution reaffirm the establishment of any on-street disabled access parking spaces that were established prior to the effective date of the ordinance codified in this chapter (On-Street Disabled Parking Spaces). If so established by resolution, the provisions of this chapter shall govern and such individuals shall be subject to the renewal requirements set forth in Section 10.10.080 and the spaces shall contain the signs and markings described in Section 10.10.050.
