12-101 Purpose And Intent
It is the purpose and intent of this article to provide for the regulation of yard sales, as defined herein, in the interests of the public health, safety and welfare and to provide an orderly appearance and cleanliness to the city and its residents. (Ord. 304-AC.)
12-102 Definitions
For the purpose of this chapter, unless the context clearly requires a different meaning, the words and phrases set forth shall have the following meanings:
- “Person” means any individual or any member or members of a family.
- “Premise” means any residence or other location at which yard sale is held.
- “Yard sale” means the sale of a person’s own personal belongings at his/her own place of residence or at another location with the written permission of the property owner. “Yard sale” also includes garage sale, patio sale, estate sale or any other similar function. (Ord. 304-AC.)
12-103 License Required
A license shall be required and obtained from the city clerk prior to the commencement of any yard sale by any person. Such license shall be issued as a “no fee” by the clerk subject to the following:
- No yard sale shall exceed a duration of three consecutive days;
- No more than three “no fee” licenses shall be issued to any person or premise in any fiscal year;
- Merchandise sold shall be the personal property of the applicant making application for the “no fee” license. Merchandise shall not be purchased by any person elsewhere with the intent of reselling at a profit at his/her own yard sale;
- All merchandise at any yard sale shall be subject to inspection by a representative of the police department;
- Should any yard shall exceed the three-day or three “no fee” license as outlined above, such yard sale shall be considered a business and shall be subject to all requirements of and required to obtain an annual license under Sec. 12-68 of this chapter. (Ord. 304-AC.)
12-104 License Required For Two Or More Person Yard Sale
A “no fee” license shall be required and obtained from the city clerk prior to the commencement of any yard sale in which two or more persons are involved. Each person shall apply for and obtain a separate license and shall be subject to and bound by the conditions contained in Sec. 12-103. (Ord. 304-AC.)
12-105 Signs
- No signs advertising a yard sale shall be allowed outside a five-hundred-foot radius of the location at which the yard sale is to be held.
- No signs shall be erected advertising a yard sale earlier than three days prior to the effective date of the license and shall be removed within twenty-four hours after the expiration of the license.
- Up to a maximum of four temporary “yard sale,” “garage sale,” “patio sale,” “estate sale” or other similar signs will be allowed on-site of the yard sale. However, all signs on-site shall not exceed a combined total of sixteen square feet.
- No sign shall be affixed to any street sign, highway sign, utility pole or any other public structure. (Ord. 304-AC.)
