16.08.090 - Rule formulation authority—Contents.

The commission shall, within four months after the effective date of the ordinance codified in this chapter, formulate forest practice rules to effectuate the purposes and policies of this chapter. The rules shall apply to the unincorporated area of the county. The rules shall include, but are not limited to, matters relating to soil erosion control, water quality and watershed control, flood control, sustained yield timber production, stand density control, reforestation methods, mass soil movements, submission of logging plans, location and grade of logging roads and skid trails, excavation and fill requirements, fire prevention and control methods, slash and debris disposal, haul routes and schedules, hours and dates of logging, preservation of fish and wildlife habitats, and performance bond requirements.

16.08.100 - Proposed rules—Public hearing.

After completing formulation of the forest practice rules, the commission shall promptly hold a public hearing at which they shall be considered. The commission shall modify the forest practice rules as it sees fit in the light of comments received at the public hearing.

16.08.110 - Proposed rules—Submittal to board of supervisors.

After the public hearing, the commission shall promptly submit the forest practice rules in written form to the board, together with such written report and recommendation as the commission may wish to make, or the board may specify. Such written report shall include a summary of the testimony and other evidence offered at the public hearing.

16.08.120 - Proposed rules—Approval conditions.

A. If, in the opinion of the board, the forest practice rules will carry out the purposes and policies of this chapter, they shall be approved by the board.

B. If the rules, or any of them, shall be disapproved by the board, they shall be returned to the commission with recommendations for modification.

C. Thereafter, the commission shall promptly repeat its consideration of the rule or rules which have been disapproved by the board, including the holding of a public hearing upon such reconsideration, and shall resubmit such rule or rules with whatever modification it wishes to recommend in the light of the board's disapproval and the commissions subsequent reconsideration.

16.08.130 - Rules considered law when approved.

Forest practice rules approved by the board shall have the force of law within the unincorporated area of the county.

16.08.140 - Revision of rules.

Forest practice rules adopted by the board may be amended or revised from time to time as may be necessary or desirable to effectuate the purposes and policies of this chapter. The commission shall formulate such revisions or amendments, and shall follow the same procedure, including the holding of a public hearing and submittal to the board for approval, as is set forth in this chapter for the forest practice rules themselves; provided, however, that the board may propose amendment or modification of the rules, which shall first be referred to the commission for public hearing, report and recommendation. Such revised or amended forest practice rules shall have the force of law upon approval by the board.
