16.20.010 - Purpose of provisions.

It is in the public interest to establish a program for the purpose of preventing contamination from and improper storage of hazardous substances stored underground. Except in those counties where a city has assumed the responsibility, every county is required to implement such a program. No city in the county has assumed the responsibility for such a program. Therefore, it is the purpose of this chapter to establish a county-wide program, including incorporated areas, to prevent contamination from, and the improper storage of, hazardous substances stored underground, all as required by state law.

16.20.020 - Contamination prevention program—Establishment—Statutory authority.

There is established in the county, in conformity with the provisions of Chapter 6.7 of Division 20 (commencing with Section 25280) of the California Health and Safety Code and the regulations adopted by the State Water Resources Control Board in conformity with Subchapter 16 of Title 23, California Administrative Code, both of which are incorporated in this section by reference, a program to prevent contamination from and improper storage of hazardous substances stored underground.

16.20.030 - Administration and enforcement.

The county department of planning, building and environmental services shall be responsible for administering and enforcing the program established by this chapter throughout the county.

16.20.040 - Fees for tank permits and operations.

A. Applications to operate an underground storage tank or to renew or amend such a permit or to construct, remove or abandon tanks shall be accompanied by that fee established by resolution of the board of supervisors.

B. The annual fee listed is in addition to a surcharge established by the Legislature annually to cover the costs of the Water Resources Control Board in carrying out its responsibilities regarding this subject.

C. County, city and district governmental entities shall not be exempt from the fees established by this section.

D. Nonprofit organizations shall not be exempt from the fees established by this section.

E. As used in this section, "person" means an individual, trust, firm, joint stock company, corporation, including a governmental corporation, partnership or association.
