Moraga Municipal Code § 5 Urgency and Taking Effect

This ordinance is an urgency measure and is for the immediate preservation of the public health, safety, and welfare. The facts constituting the urgency are these: the Town anticipates that development proposals may be submitted in the near future and the changes to the Subdivision Ordinance are necessary for the orderly review and evaluation of such proposals by the Planning staff and the Design Review Board.
The existing ordinance allows only seven (7) days for the Planning Department to review a Tentative Map application and to determine whether it is complete. This amendment will allow up to thirty (30) days for such a review. The longer period is necessary for a thorough review by the staff and is consistent with the time permitted by the State Streamlining Act.
By its design review process, the Town seeks to preserve and enhance property values, the visual character of the community and the public health, safety and welfare of its citizens. If proposals were submitted which did not comply with these amended requirements, particularly the requirement for conceptual building elevations, the design review process would be undermined and frustrated.
This ordinance is adopted under Government Code §§ 36934 and 36937 and takes effect immediately.
