16.12.010 - Procedures.

In addition to the provisions of the Act which govern tentative subdivision maps, the following procedures shall apply.

16.12.020 - Preparation and processing.

A tentative subdivision map shall be prepared and processed in accordance with the Act and the provisions of the code.

16.12.030 - Application for approval—Filing.

Application for approval of tentative subdivision maps shall be filed with the city planner on forms approved by him. Not less than thirty prints, plus a reproducible copy, of the map and application shall be submitted. No such application will be accepted for filing unless all filing and processing fees are paid or deposited simultaneously therewith.

16.12.040 - Size.

The tentative map shall be of sufficient size as determined by the city planner to clearly show the entire subdivision on one sheet. In no case shall the scale be less than one hundred feet to the inch.

16.12.050 - Required information.

Each tentative subdivision map shall contain the following information:

A. Tract number assigned by the county engineer;

B. Name and address of the owner or owners whose property is proposed to be subdivided, the name and address of the registered civil engineer, licensed surveyor, architect or other person who prepared the map, and the name and address of the subdivider if the owner is not the subdivider;

C. North point, scale, and date of preparation of the tentative map;

D. Boundary line of the subdivision;

E. The location, width, approximate grade and centerline radii of all streets within the boundaries of the proposed subdivision, and the location and width of proposed alleys and/or public service easements, labeled in a manner so as to make them easily identifiable by reference (e.g., "A Street");

F. Name, location and width of adjacent streets;

G. Lot number, lot lines and approximate dimension of each lot, and drainage direction of each lot;

H. Approximate location and width of watercourses or areas subject to inundation from floods, and the location of structures, railroads and other permanent physical features;

I. Description of the exterior boundaries of the subdivision or legal description of the property comprising the subdivision;

J. Width and location of all existing or proposed public or private easements;

K. Classification of lots as to intended residential, commercial, industrial or other uses;

L. Proposed location, direction of flow, and disposal point for storm drains and appurtenant structures;

M. Proposed location, size, direction of flow and disposal point for sanitary sewer facilities;

N. Contours, street profile and cross sections, together with the location of all cut and fill slope or a separate tentative grading plan, if necessary in the opinion of the city engineer;

O. Approximate location of existing buildings and permanent structures, labeled as to whether they will remain or be removed;

P. Location of existing trees within proposed rights-of-way to be dedicated, labeled as to whether they will remain or be removed;

Q. Location of existing and abandoned oil wells;

R. Size of subdivision in acres and the size of each lot larger than one-half acre in size;

S. Any other information relevant to the area, its improvement and design, which in the opinion of the city planner is required for proper consideration of such map.

16.12.060 - Supplemental information.

The tentative subdivision map shall show or be accompanied by reports and written statements from the subdivider giving essential information regarding the following matters:

A. Source of water supply;

B. Type of street improvement and utilities which the subdivider proposes to install;

C. Protective covenants to be recorded.

16.12.070 - Noticed public hearing.

Tentative subdivision map applications shall be noticed for public hearing before the planning commission and the city council pursuant to the provisions of the Act. In addition to notice by publication, written notice shall be mailed, not less than ten days prior to the date of the hearing, to the owners of property within three hundred feet of the exterior boundaries of the proposed subdivision, using names and addresses from the last equalized assessment roll, or alternatively, from such other records as, in the opinion of the city planner contain more current information.

16.12.080 - Planning commission recommendation.

A. Where the planning commission finds that the proposed subdivision, together with its design and improvement, is consistent with the general plan and with any applicable specific plan and satisfies the other requirements of the Act and of this title, it may recommend approval of the map. Where the planning commission finds that certain improvements or dedications are required to properly service a parcel proposed to be created, it may recommend conditional approval of the tentative map to insure that all such improvements and dedications will be made in accordance with city standards.

B. Where the planning commission finds that any of the lots proposed to be created would not comply with the Montebello Municipal Code, or that any facts exist which would, under the Act, require disapproval of a subdivision map, it shall recommend denial of the application.

16.12.090 - City council action.

The city council shall consider the application, the staff report, and all relevant evidence presented by the applicant and by other interested persons, and shall be governed in its action by the same standards as the planning commission in making its recommendation.

16.12.100 - Approval—Expiration.

A. The approval or conditional approval of a tentative subdivision map shall be valid for the term provided for in the State Map Act.

B. The expiration of the approved or conditionally approved tentative map shall terminate all proceedings and no final map or parcel map of all or any portion of the real property included within such tentative map shall be filed without first processing a new tentative map.

16.12.110 - Approval—Extensions.

A. The subdivider or his engineer may request an extension of the expiration date of the approved or conditionally approved tentative subdivision map by written application to the community development department. The application shall be filed not less than forty-five days before the map is to expire and shall state the reasons for requesting the extension.

B. The city engineer shall review the request and submit a report together with the application for the extension to the city council for approval, conditional approval or denial. The resolution adopted by the city council approving or denying the requested extension shall specify the new expiration date of the tentative subdivision map, to a period or periods not exceeding the limits for such extensions as stated in the Map Act.
