2.16.010 - Created.

A Planning Commission for the City is created.

2.16.020 - Terms of office.

The Planning Commission shall consist of five members. Such members shall serve for terms of four years. No person holding any municipal office or position in the City of Montclair being compensated by salary, excluding volunteers or persons receiving a stipend, shall be a member of the Planning Commission. Vacancies shall be filled pursuant to the City of Montclair Appointment Process Manual.

2.16.030 - Appointment.

The members of the Planning Commission shall be appointed by the Mayor with the approval of the City Council.

2.16.040 - Qualification for office.

In order to qualify as a member of the Planning Commission, a person shall be at least 18 years of age and a resident of the City.

2.16.050 - Meetings.

A. Time. Regular meetings of the Planning Commission shall be held on the second and fourth Mondays of each month.

B. Place. All regular meetings of the Planning Commission shall be held in the Council Chambers located at 5111 Benito Street, Montclair, California.

C. Holidays. Whenever a regular meeting of the Planning Commission falls on a holiday, the meeting shall be held on the next business day.

2.16.060 - Meetings - Absences.

If a member of the Planning Commission shall be absent form three successive regular meetings of the Planning Commission without cause, the office of such member shall be deemed to be vacant, and the term of such member ipso facto terminated. The Secretary of the Planning Commission shall immediately inform the Council of such termination.

2.16.070 - Meetings - Absences for cause.

An absence caused by illness, or an unavoidable absence from the City, with communication by written notice or by telephone thereof to the Secretary of the Planning Commission on or before the day of any regular meeting of the Planning Commission, shall be deemed absence for cause.

2.16.080 - Organization.

The presiding officer of the Planning Commission shall be the Chair or, in his/her absence, the Vice-Chair. The Planning Commission shall elect a Chair and Vice-Chair for two-year terms. When a vacancy occurs in the Chair's position, the Vice-Chair shall become Chair to serve the balance of the unexpired term. When a vacancy occurs in the Vice-Chair's position, the Planning Commission shall elect a successor who shall serve the balance of the unexpired term.

2.16.090 - Removal from office.

Any member of the Planning Commission may be removed by the Mayor at any time with the approval of the Council, and such removed member's successor shall serve for the unexpired term.

2.16.100 - Removal limitations.

Notwithstanding the provisions of this chapter, no Planning Commissioner shall be removed from office during or within the period of 90 days succeeding any general municipal election held in the City at which election a Member of the City Council is elected. The purpose of this provision is to permit any newly-elected Member of the City Council, or a reorganized City Council, to observe the actions and ability of the Planning Commissioners in the performance of their duties. Upon expiration of the 90-day period, the provisions of this chapter related to the removal of the Planning Commissioners shall apply and be effective.
