Modesto Municipal Code Art. 19 Utilities Department

2-3.1901 - Creation and Functions.¶
A Utilities Department is hereby established. The functions of the Utilities Department shall include:
(a) Oversee and direct all services and functions of the previously identified Utilities Planning and Projects Department, including capital improvement projects, water resource planning, groundwater, surface water and recycled water initiatives, utility rates, and regional partnerships.
(b) Oversee and direct all services, functions, and operations related to Water Operations and Maintenance.
(c) Oversee and direct all services, functions, and operations related to Wastewater Operations and Maintenance, including the Wastewater Lab and Environmental Services functions.
(d) Oversee and direct all services, functions, and operations related to Wastewater Collections functions.

2-3.1902 - Organization and Direction.¶
There shall be an Director of Utilities appointed by the City Manager and subject to the City Manager's general administrative direction. The Director of Utilities, subject to the approval of the City Manager, shall organize and maintain such divisions in the Department as operations may require, and shall be responsible for the direction and control of all functions assigned to the Department.

2-3.1903 - Acting Utilities Director.¶
In the case of absence or disability of the Director of Utilities, the City Manager shall designate a person to perform the duties and exercise the powers of the Director of Utilities.

2-3.1904 - References.¶
(a) Whenever this Code or any ordinance, resolution or other official document or action of the City of Modesto refers to or uses the titles Utilities Planning and Projects Director, Director of Utilities Planning and Projects, UPP Director, Utility Services Department Director, Director of Utility Services Department, or Utilities Director, they shall be deemed to refer to the Director of Utilities of the City of Modesto in relation to any matter under the jurisdiction of that Director.
(b) Whenever this Code or any ordinance, resolution or other official document or action of the City of Modesto refers to or uses the titles Utilities Planning and Projects Department, Department of Utilities Planning and Projects, UPP Department, or Utility Services Department, they shall be deemed to refer to the Utilities Department of the City of Modesto in relation to any matter under the jurisdiction of that Department.
