Sec. 2.06.010. - Commissions established.

There shall be established within the city a planning commission, which shall be known as the "planning and transportation commission." Whenever the phrase planning commission is used in this Municipal Code it shall refer to the planning and transportation commission. The city council may establish by resolution such other boards or commission as it deems necessary."

Sec. 2.06.020. - Number of members.

Unless otherwise specifically provided by this Code or the city council action establishing a board or commission, each board or commission shall consist of five members.

Sec. 2.06.030. - Qualifications.

Unless otherwise specifically provided by law, or by ordinance or resolution of the city council, all members of boards and commissions of the city shall, at all times during their incumbencies, be bona fide residents and registered voters of the city. No member of any board or commission shall be a city employee, nor shall any person be a member of more than one board or commission at any one time.

Sec. 2.06.040. - Applications.

The city clerk shall maintain all applications submitted to the city for board or commission positions for a period of two years.

Sec. 2.06.050. - Appointment.

Members of each board and commission shall be appointed by the city council. Each councilmember shall nominate one board or commission member regardless of the district the appointee may domicile in. Each such nomination shall require ratification by a majority of the city council. Any person appointed to a board or commission serves at the pleasure of the council and can be removed by a simple majority of the council, without cause.

Sec. 2.06.060. - Term.

(a) Each commission member shall serve a term of two years, unless sooner terminated by the city council or a limited term appointment is made pursuant to this chapter. Each term shall commence on January 1 of each year of council appointment or as soon thereafter as the appointment is made by the city council and continue for the balance of the commission member's term, unless sooner removed by the city council pursuant to this chapter or upon the nominating councilmember's leaving office. In the event a successor has not be appointed by the end of such term, the commission member shall remain in office until a successor is duly appointed and assumes office; provided, however, that the commission member shall not remain in office for a period exceeding 30 days past the expiration of the term unless the council, by majority vote of the entire council, extends this interim period for a specified period of time pending appointment and assumption of office of the successor. At the completion of any term, a commission member may be reappointed pursuant to the provisions of this chapter.

(b) No commissioner, including current incumbent commissioners or holdover commissioners as of the effective date of this section, is subject to term limits of any type or nature.

Sec. 2.06.070. - Vacancies.

If vacancies in any commission occur, other than by expiration of the term, such vacancies shall be filled by appointment for the unexpired portion of the term. The city council member who nominated the vacating commission member shall nominate a replacement. Such nomination shall require ratification by the majority of the city council. The nomination shall be made and the council shall act on the nomination within 30 days from the date of the vacancy, unless the council continues the matter for further consideration.

Sec. 2.06.080. - Meetings; quorum.

The city council shall establish meeting schedules for each board and commission by resolution. Unless otherwise provided by council resolution, a quorum of three shall be required for the transaction of any business.

Sec. 2.06.090. - Absence from meetings.

If a member of a commission has missed three consecutive regularly scheduled meetings of the commission to which he or she was appointed, the matter of the member's continued tenure on the commission shall be presented to the city council for review. The council shall decide whether to remove the member from the commission, retain the member on the commission, or temporarily remove the member from the commission and appoint a replacement member for a limited term appointment. Upon the second consecutive absence of a member from a regularly scheduled meeting of the commission, the chairperson of the commission shall notify the member in writing of the fact that the member has been absent from two consecutive meetings and shall notify the member of the provisions of this section. The failure of the chairperson to so notify the member shall not prevent the council from acting on the removal of the member.

Sec. 2.06.100. - Compensation.

Unless otherwise provided by city council resolution, board and commission members shall receive no compensation.
