Editor's note— Ord. No. 65.155, § 3, adopted September 2, 2025, amended the Code by repealing former Ch. 3.5, §§ II-3.5-1 and II-3.5-2, and adding a new Ch. 3.5. Former Ch. 3.5 pertained to similar subject matter, and derived from Ord. No. 65.152, § 3, adopted December 6, 2022.

Section 1 — Adoption of the Residential Code

Section 1 — Adoption of the Residential Code

The 2025 California Residential Code, published by the International Code Council, Inc. and the California Building Standards Commission in Part 2.5 of Title 24 of the California Code of Regulations, is hereby adopted and referred to, and by this reference expressly incorporated and made a part of this Chapter as though fully set forth herein. This adoption includes Appendix BF and Appendix BG. The 2025 California Residential Code shall be designated and referred to as the "Residential Code" for the City of Milpitas. There is one copy of said Code on file in the office of the Building Official for use and examination by the public.

Section 2 — Amendments to the Residential Code

II-3.5-2.01 - Amendment: Section R902.1.3

Amend Section R902 of the California Residential Code by adding Section R902.1.3 to read as follows:

R902.1.3 Roofing requirements for hillside construction. Class A or Class B roof covering shall be required for all hillside construction.

II-3-3.5-2.02 - Amendment: Table R602.10.3(3)

Amend Table R602.10.3(3) title and footnotes to read:

Footnotes:

i. Methods PBS, HPS, SFB and CS-SFB are not permitted in Seismic Design Categories D 0 , D 1 , and D 2 .

j. Methods GB, DWB and PCP are not permitted in Seismic Design Categories D 0 , D 1 , and D 2 where S 1 is greater than or equal to 0.75.

II-3.5-2.03 - Amendment: Section R403.1

Amend Section R403.1 of the California Residential Code by adding the following:

All new foundations for building additions to R-3 occupancies shall be of the same type of foundation system as the existing structure, unless foundation design recommendation from a soils engineer is provided and the foundation system is designed, and plans, calculations, and specifications are prepared, stamped and signed, by a California licensed engineer or architect.
