Editor's note— Ord. No. 65.155, § 3, adopted September 2, 2025, amended the Code by repealing former Ch. 3, §§ II-3-1 and II-3-2, and adding a new Ch. 3. Former Ch. 3 pertained to similar subject matter, and derived from Ord. No. 65.152, § 3, adopted December 6, 2022.

The 2025 California Building Code, published and copyrighted by the International Code Council, Inc. and the California Building Standards Commission in Part 2 of Title 24 of the California Code of Regulations, is hereby adopted and referred to, and by this reference expressly incorporated and made a part of this Chapter as though fully set forth herein. This adoption includes Appendix I. The 2025 California Building Code shall be designated and referred to as the "Building Code" for the City of Milpitas. There is one copy of said Code on file in the office of the Building Official for use and examination by the public.

Amend Section 402.5 of the California Building Code by deleting the exception.

Amend Section 403.3 of the California Building Code by deleting all exceptions.

Amend Section 404.3 of the California Building Code by deleting all exceptions.

Amend Section 410.6 of the California Building Code by deleting all exceptions.

Amend Section 1505 of the California Building Code by adding Section 1505.1.3 to read as follows:

1505.1.3 Roofing requirements for hillside construction. Class A or Class B roof covering shall be required for all hillside construction.

Amend Section 1705.3 Exception 1 of the California Building Code to read as follows:

1. Isolated spread concrete footings of buildings three stories or less above grade plane that are fully supported on earth or rock, where the structural design of the footing is based upon a specified compressive strength, f' c , no greater than 2,500 pounds per square inch (psi) (17.2 MPa).

Amend Section 1808.1 of the California Building Code by adding the following:

All new foundations for building additions to R-3 occupancies shall be of the same type of foundation system as the existing structure, unless foundation design recommendation from a soils engineer is provided and the foundation system is designed, and plans, calculations, and specifications are prepared, stamped and signed, by a California licensed engineer or architect.

2. Footnotes "f" and "g" are added to Table 2308.10.1, to read:

f. Methods PBS, HPS, and SFB are not permitted in Seismic Design Categories Dor E.
